RULES FOR PARTICIPATION IN THE ADVERTISING AND MARKETING PROMOTION "UNITY ENERGY"

• The promotion is conducted in accordance with the terms of these Rules (Official Terms).
• The Organizer and the Performer are not responsible for failure to acquaint the Participant with these Rules.

1. Organizer, Executor and Partners of the Promotion
1.1. The organizer of the advertising and marketing Promotion called "ENERGY OF UNITY" (hereinafter - the "Promotion") is the LIMITED LIABILITY COMPANY "TRC LAVINA", located at the address: 6D Berkovetska Street, Kyiv (TRC "Lavina")
1.2. The Executor of the Action is FOP Zeykan Yury Denisovych (Registration number OKPP 3509007037).

2. Basic provisions of the Promotion
2.1. Who has the right to participate in the promotion?
■ All citizens of Ukraine who permanently reside in Ukraine and who have reached the age of 18 at the start of the Promotion;
■ Participants of the Promotion may be natural persons, provided they fulfill the conditions of participation in the Promotion provided by these Rules.
2.2. The following are not recognized as participants of the Promotion and do not have the right to participate in the Promotion:
■ persons who were under 18 years of age at the time of the Promotion;
■ persons who have not fulfilled the conditions of these Rules;
■ non-residents of Ukraine;
■ owners and employees of the Organizer/Executive or representatives of the tenants of the "Lavina" shopping center (including, but not limited to: service personnel of the shops of the "Lavina" shopping center), owners and employees of other third parties involved in the Promotion and
service of the "Lavina" shopping center, including advertising agencies, cleaning, security and other organizations, as well as immediate members of their families.
2.3. The promotion is held on the territory of the "Lavina" shopping center, located at the address: Kyiv, Berkovetska Street, 6D (hereinafter - the shopping center) and will last from 26.02.2023 to 30.09.2023 inclusive (hereinafter - the "Promotion Period").
The period of the Promotion may be changed by means of a notification on the official website of the shopping center https://lavinamall.ua/ and the Organizer's social media pages.

3. Products participating in the Promotion
3.1. Products purchased from all tenants of the "Lavina" shopping center (hereinafter referred to as "Products") participate in the Promotion, except for Goods sold in the territory of the "Silpo" supermarket, the list and location of which can be found on the website of the shopping center https://lavinamall. ua/ or directly in the shopping center at the information counters/stands.

4. Conditions and procedure for participation in the Promotion
4.1. To acquire the status of a Participant of the Promotion, you must:
4.1.1. During the Promotion period, make a purchase in the amount of UAH 1,000.00 (one thousand hryvnias 00 kopecks) with one check in stores located on the territory of the "Lavina" shopping center (with the exception of the "Silpo" supermarket), which must be confirmed the presence of settlement documents (fiscal or commercial, properly executed checks), which must clearly indicate the place (address) of the purchase, the date and amount of the purchase, and register the settlement document;
4.1.2. Register a settlement document confirming the purchase, which
meets the conditions of the Promotion, by filling out the electronic questionnaire at the link https://forms.gle/7bSxMn3gNjbtF3wy6
4.2. The Participant of the Promotion can register by filling out an electronic questionnaire on his own or with the help of promoters, at the promotional counter on the territory of the "Lavina" shopping center.
Working schedule of the promo counter:
From Monday to Thursday: from 15:00 to 19:00;
Friday, Saturday, Sunday, and all weekends - from 12:00 to 20:00.
4.3. The electronic questionnaire is filled out by entering the information necessary to participate in the Promotion, namely: Surname, first name, patronymic, amount of the check, date of purchase, name of the store where the purchase was made, photo of the receipt, e-mail, phone number.
For each participant/cheque, his personal number is recorded in the database of the participants of the Promotion.
4.4. A participant who has fulfilled the conditions of the Promotion - participates in the draw for Prizes from Partners.
Only payment documents (cheques) of the participant of the Promotion with the date and time corresponding to the period of the Promotion and for which the registration in the Promotion has been made, in accordance with the conditions of these Rules, are allowed to participate in the Promotion.
The following settlement documents (fiscal or sales receipts) do not meet the conditions of the Promotion:
■ received during purchases made outside the Promotion Period (before 02/26/2023 00:00 and after 03/30/2023 18:00;
■ executed in violation of the terms of these Rules;
4.5 One Participant has the opportunity to register an unlimited number of checks for participation in the Promotion during the entire period of the Promotion, provided that all conditions of these Rules are met.
4.6. By participating in the Promotion, the Participants of the Promotion thereby confirm the fact of familiarization with these Promotion Rules and their full and unconditional agreement with them.
4.7. Participants of the Promotion, participating in the Promotion, voluntarily agree to provide the Promoter with information (including personal information) determined by the Organizer and the Promoter as necessary to receive the relevant Promotion Prize.
4.8. Violation of these Rules by the Participants of the Promotion or the refusal of the Participants of the Promotion to properly comply with these Rules (including the mechanics, procedure and deadlines of the Promotion and/or receiving the Prizes of the Promotion, etc.) is considered a refusal of the Participant to participate in the Promotion. At the same time, such a person does not have the right to receive from the Organizer and Executor of the Promotion and/or third parties engaged by them of any compensation.
4.9. The participants of the Promotion must keep the original settlement documents (cheques) for the Goods on the basis of which they participate in the Promotion in order to confirm the purchase in the "Lavina" shopping center during the period of the Promotion.
4.19. The Organizer and Executor of the Promotion has the right to demand from the Participant of the Promotion to present the original settlement documents (cheques) for the Goods participating in the Promotion at any time at its discretion.

5. Prize fund of the Action
5.1. The prize fund of the Promotion is limited.
Main prizes:
- Apple AirPods Max headphones (MGYH3) - 1 pc
5.2. The Organizer and Executor of the Promotion and/or third parties engaged by them ensure the transfer/handover of the Promotion prizes to the Promotion Winners. Compliance with the requirements of the legislation of Ukraine regarding the taxation of the value of income as a result of receiving the Prizes of the Promotion is ensured by the Partner in accordance with the requirements of the legislation of Ukraine.
5.3. Prizes of the Promotion may be received by the Winners of the Promotion only under the conditions specified in these Rules.
5.4. The appearance and content of the Prizes of the Promotion may differ from their images on promotional materials of the Promotion, and may not meet the expectations of the Promotion Participants.
5.5. One Promotion Winner may receive several Promotion Prizes, if this is determined by the corresponding number of winning questionnaires of the Promotion Participant within the relevant Promotion Prize draw.

6. Conducting the prize draw:
6.1. Prizes are drawn exclusively for checks in the amount of UAH 1,000.00 or more. (one thousand hryvnias), which were registered during the Promotion. The winner is determined randomly through the program.
The draw will be held on the following days:
- September 30, 2023.
The Organizer can inform about the exact time of the Raffle on the official website of the Shopping Center https://lavinamall.ua/ and on the Organizer's social media pages.
The Organizer has the right to change the dates and times of the Draw.
6.2. The prize drawing will take place during the event on the central stage of the Avalanche Shopping Center. After registration, each participant is assigned his personal number, which will be used during the draw. The winner will be determined using the Internet
resource (program) https://www.random.org/. The host of the event will open the list of all participants and indicate in the appropriate fields of the program the numbers from 1 to the number that will correspond to the serial number of the participant who registered last in the draw. The number selected by the program will be the winner of the Promotion. Base with serial numbers will be available
after completing registration on the official resources of the "Lavyna" shopping center.
6.3. Winners will be notified of their victory in the Promotion immediately during the draw.
6.4. The awarding of prizes takes place after the raffle on the central stage of the "Lavina" shopping center. The presence of the winner at the event is MANDATORY.
6.5. Winners can receive the prize in person on the day of the draw at the Lavina shopping center near the central stage.
The Organizer/Performer has the right to ask the Participant:

● a copy of the passport and identification number;
● the original of the settlement document (check) that was registered in the Promotion, exclusively for familiarization and verification of compliance by the Participant of the Promotion with all the terms of the Promotion;
6.6. At the request of the Organizer/Performer, the Winner of the Promotion may have the opportunity to receive the Prize after the Organizer and the Performer have checked the original payment document (cheque) specified by the Winner when registering for the Promotion, as well as on condition of providing a copy of the passport and identification number, at the place of awarding of prizes after the draw (provided that there is no application by the Winner to return the high-quality Goods according to the payment document (cheque), which became the basis for determining the Winner, in accordance with the requirements of Article 9 of the Law "On the Protection of Consumer Rights") and signing a statement confirming receipt of the Prize and consent to processing personal data. In the event that the Winner (or another person) submits an application for the return of the Goods against the fiscal check, which became the basis for determining the Winner, within the terms specified by the legislation of Ukraine, the Winner loses the right to receive the Prize.

6.7. Prize/Prizes cannot be returned or exchanged.
6.8. The Organizer and the Performer are not responsible for any disputes regarding the Prize/Prizes, the Organizer/Performer does not enter into any disputes regarding the recognition of any person as a Participant/Winner and the rights to receive the Prize/Prizes.
The Organizer and the Executor are not responsible for determining the rights of the parties in any disputes.
6.9. The Organizer and the Executor are not responsible in the event of force majeure, such as natural disasters, fire, flood, military actions of any nature, blockades, significant changes in the legislation in force in the territory of the Promotion, others beyond the control of the Organizer / Performer.
6.10. The Organizer and the Performer are not responsible for any expenses of the Winner related to receiving and further use of the Prize/Prizes.
6.11. The Organizer and the Performer have the right to:
■ deny participation in the Promotion to a person who has not fulfilled/improperly fulfilled all the conditions for participation in the Promotion specified in these Rules;
■ refuse to issue a Prize/Prizes to a Winner who has not fulfilled the conditions necessary to receive such a Prize/Prizes, in accordance with these Rules.
6.12. The Organizer and the Performer bear no responsibility for the accuracy of the information provided by the Participants of the Promotion, including contact information with them.
6.13. The winner, when receiving the corresponding Prize, signs with
The Organizer/Performer submits a statement-confirmation of receipt of the Prize, and consent to the processing of personal data, the forms of which are determined by the Organizer/Performer, on the basis of which the Winner of the Promotion receives the Prize.
6.14. The Winner's refusal to receive the Prize and/or sign the Confirmation Statement, as well as providing it later than the specified period or providing information that has signs of falsification or is unreliable/incorrect, deprives the Winner of the right to receive the Prize and is considered the winner's refusal to receive the Prize.
6.15. If the Winner is unable/willing to use/receive the Prize for reasons beyond the control of the Performer/Organizer, the Performer/Organizer shall not pay the Winner any compensation related to such inability to use/receive the Prize.
6.16. Replacement of the Prize with other goods/services is not allowed.

7. OTHER TERMS
7.1. The Organizer/Performer reserves the right to change these Rules, the date and time of the draw/draws and the determination of the Winner, other conditions. Information about the changed date for determining the Winners can be found on the official website: https://lavinamall.ua/
7.2. The Organizer/Performer of the Promotion is not responsible for the impossibility of receiving the Prize by the Winner for any reason beyond the control of the Organizer/Performer of the Promotion, including due to the Winner specifying incorrect/or incomplete data, etc., which are necessary for accepting participation in the Promotion, illness, vacation of the Winner, interruptions in the work of communication operators of Ukraine, etc. At the same time, such a Winner is deprived of the right to receive any compensation from the Promoter/Performer of the Promotion.
7.3. The Organizer/Performer of the Promotion is not responsible for the future use of the Prizes.
7.4. The Winner agrees that in case he receives the Prize, his personal data, which were provided to the Organizer/Performer, as well as the recording of the process of awarding the Prize itself, may be used in printed, audio and video materials without the additional special consent of the Winner, and such use in no way The winner is not paid.
7.5. The Organizer/Performer of the Promotion shall not bear any responsibility for failure to conduct the Promotion or award the Prize in the event of force majeure (including natural disasters, fires, floods, military actions of any nature, blockades, terrorist attacks, reports of landmines , significant changes in the current legislation in force in the territory
conduct of the Promotion, etc.) or other circumstances that make it impossible or difficult to fulfill duties, and do not depend on the will of the Organizer/Executive.
7.6. In the event of a situation that suggests an ambiguous interpretation of these Rules, any disputed issues and/or issues not regulated by these Rules, the final decision is made by the Organizer/Executive of the Promotion. Decision of the Organizer/Executive
Actions are final and non-appealable.
7.7. The fact of filling out the Participant's Questionnaire means the Participant's full consent to all provisions of the Official Terms of the Promotion, as well as consent to the use, storage and processing of their personal data in accordance with the Law of Ukraine "On the Protection of Personal Data", on their transfer to third parties, for marketing and/or any other purpose, by methods that do not contradict the current legislation of Ukraine (including by transfer to third parties), in particular, for the free use of his name, surname, image (photo or video ), interviews or other materials about him for advertising purposes, including the right to publish his name and image (photo or video) in mass media, any printed, audio and video materials, interviews with mass media, without restrictions on the territory and term of such use, and such use is not compensated (not paid for) by the Organizer, Partner-Customer or third parties. Also, it is considered that the Participant has given his consent to the use of his name and image within the meaning of Art. 296, 307, 308 of the Civil Code of Ukraine.
Participants are familiarized with their rights provided for in Art. 8 of the Law of Ukraine "On Protection of Personal Data".

7.8. In cases where the Partners, while fulfilling their obligations within the scope of this Promotion, carry out any operations that are subject to taxation in accordance with the legislation of Ukraine, the Partners ensure the payment of all taxes, fees and mandatory payments provided for by the current legislation of Ukraine. including personal income tax; preparation and submission of relevant tax reporting.
Taking into account the terms of this paragraph, the Winner agrees that the Partner's payment of relevant taxes, fees and mandatory payments, including personal income tax, does not exempt the Winner, in accordance with Article 67 of the Constitution of Ukraine and Article 179 of the Tax Code of Ukraine, from submitting an annual declaration on one's property status and income for the past year.
7.10. The rules are approved by the Promoter/Performer of the Promotion and are valid for the duration of the Promotion.
