RULES FOR PARTICIPATION IN THE PROMOTION "BIRTHDAY OF AVALANCHE SHOPPING CENTER". 7 YEARS"
(hereinafter referred to as "Official Terms" or "Rules")
■ The campaign is conducted in accordance with the terms of these Rules (Official Terms).
■ The Customer and the Organizer are not responsible for failure to acquaint the Participant with these Rules.
1. Customer, Organizer and Partner of the Promotion
1.1. The customer of the Promotion called "BIRTHDAY OF AVALANCHE MALL. 7 YEARS" (hereinafter -
"Action") is represented by "LAVINA SHOPPING SHOP" LIMITED LIABILITY COMPANY, located at the address: Kyiv, Berkovetska Street, 6D ("Lavyna Shopping Center")
1.2. The organizer of the Action is FOP Zeykan Yury Denisovych (Registration no
OKPP 3509007037).
1.3. Promotion partner:
- Limited Liability Company "INNOVATIONS XXI SOLITTYA" taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 43872565 (Trademark "Yabluka")
2. Basic provisions of the Promotion
2.1. Who has the right to participate in the promotion?
■ All citizens of Ukraine who permanently reside in Ukraine and who have reached the age of 18 at the start of the Promotion;
■ Participants of the Promotion may be natural persons, provided they fulfill the conditions of participation in
Actions provided for by these Rules.
2.2. The following are not recognized as participants of the Promotion and do not have the right to participate in the Promotion:
■ persons who were under 18 years of age at the time of the Promotion;
■ persons who have not fulfilled the conditions of these Rules;
■ non-residents of Ukraine;
■ owners and employees of the Customer/Organizer/Partner or representatives of the tenants of the "Lavyna" Shopping Center (including, but not limited to: store staff of the "Lavyna" Shopping Center), owners and employees of other third parties involved in the Promotion and maintenance of the "Lavyna" Shopping Center ", including advertising agencies, cleaning, security and other organizations, as well as immediate members of their families.
2.3. The promotion is held on the territory of the "Lavyna" shopping center, located at the address: m. Kyiv, Berkovetska Street, 6D (hereinafter - shopping mall) and will last from 10:00 a.m. 29.10.2023 to 02.12.2023 18:00 inclusive (hereinafter referred to as the "Period of the Promotion"). The period of the Promotion may be changed by notification on the official website of the shopping center https://lavinamall.ua/ and the Customer's social media pages.
3. Products participating in the Promotion
3.1. Products purchased from all tenants of the "Lavina" shopping center (hereinafter referred to as "Products") participate in the Promotion, except for the Goods sold in the territory of the "Silpo" supermarket, the list and location of which can be found on the website of the shopping center https://lavinamall.ua/ or directly in the shopping center at information counters/stands.
4. Conditions and procedure for participation in the Promotion
4.1. To acquire the status of a Participant of the Promotion, you must:
4.1.1. During the Promotion period, make a purchase in the amount of UAH 1,000.00 (one thousand hryvnias 00 kopecks) with a single check in stores located on the territory of the "Lavyna" shopping center (with the exception of the "Silpo" supermarket), which must be confirmed the presence of settlement documents (fiscal or commercial receipts duly drawn up), which must clearly indicate the place (address) of the purchase, the date and amount of the purchase, and register the settlement document;
4.1.2. Register a settlement document confirming the purchase that meets the conditions of the Promotion by filling out the electronic questionnaire at the link https://docs.google.com/forms/d/e/1FAIpQLScy42tfL1pPePfjsEf2bOUi-tlwTLnDsHYDXhGffrVYqpJo8g/viewform
4.2. Registration by filling out an electronic questionnaire can be done by the Promotion Participant independently or with the help of promoters, at the promo counter on the territory of the "Lavyna" shopping center.
Working schedule of the promo counter:
From Monday to Thursday: from 15:00 to 19:00;
Friday, Saturday, Sunday and all weekends - from 12:00 to 20:00.
4.3. The electronic questionnaire is filled out by entering the information necessary to participate in the Promotion, namely: Surname, first name, patronymic, amount of the check, date of purchase, name of the store where the purchase was made, photo of the receipt, e-mail, phone number.
For each Participant/cheque, his personal number is fixed in the database of the participants of the Promotion.
4.4. The Participant who fulfilled the conditions of the Promotion takes part in the drawing of Prizes from the Partner.
Only payment documents (cheques) of the Participant of the Promotion with the date and time corresponding to the period of the Promotion and for which the registration in the Promotion has been made, in accordance with the terms of these Rules, are allowed to participate in the Promotion.
The following settlement documents (fiscal or sales receipts) do not meet the conditions of the Promotion:
■ which were received during purchases that were made outside the Promotion Period (before 10.29.2023 10:00 a.m. and after 12.02.2023 6:00 p.m.;
■ executed in violation of the terms of these Rules;
4.5 One Participant has the opportunity to register an unlimited number of checks to participate in Promotions during the entire Promotion period, subject to the fulfillment of all conditions of these Rules.
4.6. By participating in the Promotion, the Participants of the Promotion thereby confirm the fact of familiarization with these Promotion Rules and their full and unconditional agreement with them.
4.7. Participants of the Promotion, participating in the Promotion, voluntarily agree to provide the Promotion Organizer with information (including personal information) determined by the Customer and the Promotion Organizer as necessary to receive the relevant Promotion Prize.
4.8. Violation of these Rules by the Participants of the Promotion or refusal of the Participants of the Promotion compliance with these Rules (including the mechanics, order and terms of the Promotion and/or receipt of the Promotion Prizes, etc.) is considered the Participant's refusal to participate in the Promotion. At the same time, such a person does not have the right to receive any compensation from the Customer and the Promotion Organizer and/or the third parties engaged by them.
4.9. The participants of the Promotion must keep the original settlement documents (cheques) for the Goods, on the basis of which they participate in the Promotion, in order to confirm the purchase in the "Lavyna" Shopping Center during the period of the Promotion.
4.10. The Customer and the Promotion Organizer have the right to request the Promotion Participant to present the original settlement documents (cheques) for the Goods participating in the Promotion at any time at their discretion.
5. Prize fund of the Action
5.1. The prize fund of the Promotion is limited.
Main prizes:
- Laptop APPLE MacBook Pro M1 Pro 16` 512GB – 4 pcs.
- iPhone 15 Pro Max 256 Gb – 1 pc.
5.2. The Customer and the Organizer of the Promotion and/or third parties engaged by them ensure the transfer/handover of the Promotion prizes to the Promotion Winners. Compliance with the requirements of the legislation of Ukraine regarding the taxation of the value of income as a result of receiving the Prizes of the Promotion is ensured by the Partner in accordance with the requirements of the legislation of Ukraine.
5.3. Prizes of the Promotion may be received by the Winners of the Promotion only under the conditions specified in these Rules.
5.4. The appearance and content of the Promotional Prizes may differ from their images on the promotional materials of the Promotion, and may not meet the expectations of the Promotional Participants.
5.5. One Promotional Winner may receive several Promotional Prizes, if this is determined by the corresponding number of winning Surveys of the Promotional Participant within the relevant Promotional Prize draw.
6. Conducting the prize draw:
6.1. Prizes will be drawn exclusively for checks in the amount of UAH 1,000.00 or more that were registered during the Promotion. The winner is determined randomly
through the program.
The draw will be held on the following days:
- December 2, 2023;
The Customer can inform about the exact time of the Raffle on the official website
Mall https://lavinamall.ua/ and on the Customer's social media pages.
The Customer has the right to change the dates and time of the Raffle.
6.2. The prize drawing will take place online, with the drawing broadcast on The Customer's Instagram page https://www.instagram.com/lavinamall.ua/ is live.
After registration, each Participant is assigned his personal number, which will be used during the draw. The winner will be determined using the Internet resource (program) https://www.random.org/. The host of the live broadcast will open the list of all Participants and indicate in the appropriate fields of the program numbers from 2 to the number that will correspond to the serial number of the Participant who registered last in the draw. The participant whose number is selected by the program will be the winner of the Promotion. The raffle will be held live. The database with serial numbers will be available after registration is completed on the official resources of the "Lavyna" shopping center.
6.3. Winners will be notified of their victory in the Promotion immediately during the draw.
6.4. Prizes will be awarded after the draw.
Contacts for receiving Prizes will be notified by the Customer on the official website of the shopping center
https://lavinamall.ua/ and on the Customer's social media pages.
6.5. Winners can receive the Prize in person.
The Customer/Organizer has the right to ask the Participant:
● a copy of the passport and identification number;
● the original settlement document (cheque) that was registered in the Promotion,
exclusively for familiarization and verification of the Participant's compliance with the Promotion of all conditions of the Promotion;
6.6. At the request of the Customer/Organizer, the Winner of the Promotion may be able to receive the Prize after verification by the Customer and the Organizer of the original settlement document (cheque) specified by the Winner when registering for the Promotion, as well as on condition of providing a copy of the passport and identification number, at the place of awarding of prizes after the draw (provided that there is no application by the Winner to return the high-quality Goods according to the settlement document (cheque), which became the basis for determining the Winner, in accordance with the requirements of Article 9 of the Law "On the Protection of Consumer Rights") and signing a statement confirming receipt of the Prize and consent to processing personal data. In the event that the Winner (or another person) submits an application for the return of the Goods against the fiscal check, which became the basis for determining the Winner, within the terms specified by the legislation of Ukraine, the Winner loses the right to receive the Prize.
6.7. Prize/Prizes cannot be returned or exchanged.
6.8. The Customer and the Organizer do not assume responsibility in relation to any
disputes regarding the Prize/Prizes, the Customer/Organizer does not enter into any disputes regarding the recognition of any persons as Participants/Winners and the rights to receive the Prize/Prizes.
The Customer and the Organizer are not responsible for determining the rights of the parties any disputes.
6.9. The Customer and the Organizer are not responsible in the event of force majeure
circumstances, such as natural disasters, fire, flood, military actions of any nature, blockades, significant changes in the legislation in force in the territory of the Promotion, others beyond the control of the Customer/Organizer
6.10. The Customer and the Organizer are not responsible for any expenses of the Winner related to the receipt and further use of the Prize/Prizes.
6.11. The Customer and the Organizer have the right to:
■ deny participation in the Promotion to a person who has not fulfilled/improperly fulfilled all
conditions of participation in the Promotion specified in these Rules;
■ refuse to issue the Prize/Prizes to the Winner who has not fulfilled the conditions necessary for receiving such Prize/Prizes, in accordance with these Rules.
6.12. The Customer and the Organizer bear no responsibility for the reliability of the information provided by the Participants of the Promotion, including contact information with them.
6.13. When receiving the corresponding Prize, the Winner signs with the Customer/Organizer/a statement confirming receipt of the Prize, and consent to the processing of personal data, the forms of which are determined by the Customer/Organizer, on the basis of which the Winner of the Promotion receives the Prize.
6.14. The Winner's refusal to receive the Prize and/or to sign the Confirmation Statement, as well as providing it later than the specified period or providing information that has signs
falsification or is unreliable/incorrect, deprives the winner of the right to receive the Prize and is considered a refusal by the Winner to receive the Prize.
6.15. If the Winner does not have the opportunity/desire to use/receive the Prize from
for reasons beyond the control of the Customer/Organizer, the Customer/Organizer shall not pay the Winner any compensation related to such impossibility
use/acquisition of the Prize.
6.16. Replacement of the Prize with other goods/services is not allowed.

7. OTHER TERMS
7.1. The Customer/Organizer reserves the right to change these Rules, date and time
conducting the raffle/raffles and determining the Winner, other conditions. Information about the changed date for determining the Winners can be found on the official website:

7.2. The Customer/Organizer of the Promotion is not responsible for the impossibility of receipt The winner of the Prize for any reason beyond the control of the Customer/Organizer of the Promotion, including due to the fact that the Winner entered incorrect/or incomplete data, etc., which are necessary for accepting participation in the Promotion, the Winner's illness, vacation, interruptions in the work of communication operators of Ukraine, etc. At the same time, such a Winner is deprived of the right to receive any compensation from the Customer/Organizer of the Promotion.
7.3. The Customer/Organizer of the Promotion is not responsible for the future
use of Prizes.
7.4. The Winner agrees that in the event of his receiving the Prize, his personal data, which were provided to the Customer/Organizer/, as well as the recording of the Prize awarding process itself, may be used in printed, audio and video materials without the additional special consent of the Winner, and such use by no in this way the Winner is not paid.
7.5. The Customer/Organizer of the Promotion shall not bear any responsibility for failure to conduct the Promotion or award the Prize in case of force majeure (including natural disasters, fires, floods, military operations of any nature, blockades, terrorist attacks, reports of landmines , significant changes in the current legislation in force in the territory of the Promotion, etc.) or other circumstances that make it impossible or difficult to fulfill obligations, and do not depend on the will of the Customer/Organizer/.
7.6. In the event of a situation that implies an ambiguous interpretation of these Rules, any disputed issues and/or issues not regulated by these Rules, the final decision is taken by the Customer/Organizer/Promotion. The decision of the Customer/Promotion Organizer is final and not subject to appeal.
7.7. The fact of filling out the Participant's Questionnaire means that the Participant gives full consent to all of them provisions of the Official Conditions of the Promotion, as well as consent to the use, storage and processing of their personal data in accordance with the Law of Ukraine "On the Protection of Personal Data", to their transfer to third parties, for marketing and/or any other purpose, methods that do not contradict to the current legislation of Ukraine (including by transfer to third parties), in particular, for the free use of his name, surname, image (photo or video), interview or other materials about him for advertising purposes, including the right to publish his name and image (photo or video) in the mass media, any printed, audio and video materials, interviews with the media, without limitation on the territory and term of such use, and such use is not compensated (not paid for) by the Organizer, Partner , the customer or third parties. Also, it is considered that the Participant has given his consent to the use of his name and image within the meaning of Art. 296, 307, 308 of the Civil Code of Ukraine.
Participants are familiarized with their rights provided for in Art. 8 of the Law of Ukraine "On Protection of Personal Data".
7.8. In cases where the Partner, while fulfilling the obligations assumed within the scope of this Promotion, carries out any transactions that are subject to taxation in accordance with the legislation of Ukraine, the Partner ensures the payment of all taxes, fees and mandatory payments provided for by the current legislation of Ukraine, including personal income tax; preparation and submission of relevant tax reporting. Taking into account the terms of this paragraph, the Winner agrees that the Partner's payment of relevant taxes, fees and mandatory payments, including personal income tax, does not exempt the Winner, in accordance with Article 67 of the Constitution of Ukraine and Article 179 of the Tax Code of Ukraine, from submitting an annual declaration on one's property status and income for the past year.
7.10. The rules are approved by the Customer/Organizer/Promotion and are valid for the duration duration of the Promotion.
