RULES FOR PARTICIPATION IN THE "GIVE AWAY EXCLUSIVE SHOPPER!" PROMOTION

(hereinafter referred to as "Official Terms" or "Rules")

• The promotion is conducted in accordance with the terms of these Rules (Official Terms).
• The Customer and the Organizer are not responsible for failure to acquaint the Participant with these Rules.

1. Customer and Promotion Organizer

1.1. The customer of the Promotion called "GIVE AWAY EXCLUSIVE SHOPPER!" (hereinafter - the "Action") is represented by the LIMITED LIABILITY COMPANY "TLVINA SHOPPING", taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 38537759.

1.2. The organizer of the Action is FOP Zeykan Yury Denisovych (Registration number OKPP 3509007037).

The promotion includes a promotion that will be held offline on the territory of the "Lavyna" shopping and entertainment center (hereinafter referred to as the Promotion in the Shopping Center) and an online promotion (hereinafter referred to as the Online Promotion).

2. Prize fund of the Action

2.1. The prize fund of the Promotion is limited.

Promotion prizes:

Shopper bag, material felt, total quantity 500 pcs.:

• 498 shoppers – Prizes Promotions in shopping centers;
• 2 shoppers - Prizes Promotions online.

2.2. The Customer and the Organizer of the Promotion and/or third parties engaged by them ensure the transfer/handover of the Promotion prizes to the Promotion Participants/Winners. Compliance with the requirements of the legislation of Ukraine regarding the taxation of the value of income as a result of receiving the Prizes of the Promotion is ensured by the Organizer in accordance with the requirements of the legislation of Ukraine.
2.3. Prizes of the Promotion can be received by the Participants/Winners of the Promotion only under the conditions specified in these Rules.
2.4. The appearance and content of the Prizes of the Promotion may differ from their images on promotional materials of the Promotion, and may not meet the expectations of the Promotion Participants.
2.5. One Participant can receive one Prize within the Promotion in the mall and one Prize within the Promotion online.

WARNING! This Promotion is not a game of chance, lottery, gaming service, or contest, and these Rules are not a public promise of reward or contest terms.

3. Basic provisions of the Promotion in the shopping center

3.1. The action in the mall is held on the territory of the "Lavina" shopping and entertainment center, located at the address: Kyiv, Berkovetska Street, 6D (hereinafter - the mall) and will last from 10:00 a.m. until 10:00 p.m. 04/03/2024 (hereinafter referred to as the "Promotion Period").

The period of the Promotion in the mall can be changed by means of a notification on the official website of the mall https://lavinamall.ua/ and pages in the Customer's social networks.

3.2. Who has the right to participate in the Promotion in the shopping center?

• All citizens of Ukraine who permanently reside in Ukraine and who have reached the age of 18 at the start of the Promotion in the shopping center;
• Individuals can participate in the Promotion in the mall, provided they fulfill the conditions for participation in the Promotion in the mall, provided for in these Rules.

3.3. The following are not recognized as participants in the Promotion in the shopping center and do not have the right to participate in the Promotion in the shopping center:

• persons who were under 18 years of age at the time of the Promotion in the shopping center;
• persons who have not fulfilled the conditions of these Rules;
• non-residents of Ukraine;
• owners and employees of the Customer/Organizer or representatives of the tenants of the "Lavyna" TRC (including, but not limited to: service personnel of the "Lavyna" TRC stores), owners and employees of other third parties involved in the Promotion and maintenance of the "Lavyna" TRC, in including advertising agencies, cleaning, security and other organizations, as well as immediate members of their families.

4. Goods, the purchase of which gives the right to participate in the Promotion in the shopping center

4.1. A mandatory condition for participation in the Promotion in the shopping mall is the purchase of goods on the territory of the "Lavyna" shopping mall on April 3, 2024 (hereinafter - "Goods"). The list and location of stores, the purchase of goods in which gives the right to participate in the Promotion in the mall, can be found on the website of the mall https://lavinamall.ua/ or directly in the mall at the information counters/stands.

5. Conditions and procedure for participation in the Promotion in the shopping center

5.1. In order to acquire the status of a Participant of the Promotion in the shopping mall, you must:

5.1.1. During the Promotion period, purchase Goods in the amount of at least UAH 1,500.00 (one thousand five hundred hryvnias and 00 kopecks) with a single check in stores located on the territory of the Lavina Shopping Center, which must be confirmed by the presence of settlement documents (fiscal or commodity checks duly executed), on which the place (address) of the purchase, the date and the amount of the purchase must be clearly indicated.

5.1.2. Register a settlement document confirming the purchase that meets the conditions of the Promotion in the shopping center by filling out the Questionnaire during the Promotion period at the registration desk in the "Lavyna" shopping center next to the "Nikko" restaurant. Registration is carried out by recording information about the Participant by the promoter, namely: last name, first name, patronymic, amount of the check, date of purchase, name of the store where the purchase was made, e-mail, phone number.

5.1.3. Get a Prize

5.2. The number of Participants of the Promotion is limited! The prize is awarded exclusively to the first 498 people who registered as Participants of the Promotion in accordance with Clause 5.1 of the Rules. Such persons are considered Winners of the Promotion in the shopping center.

5.3. Hours of operation of the registration desk and promoters:

04/03/2024 from 10:00 a.m. before the registration of the Participant under No. 498, but in any case no later than 10:00 p.m.

After the registration of Participant No. 498, the registration of the Participants and the work of the promo counter and promoters are terminated in any case, and the Promotion in the shopping center is considered to have taken place.

5.4. Only settlement documents (cheques) of the Participant of the Promotion in the shopping center with the date and time corresponding to the period of the Promotion in the shopping center, and for which the registration in the Promotion in the shopping center has been made in accordance with the terms of these Rules, are allowed to participate in the Promotion in the shopping center.

The following settlement documents (fiscal or sales receipts) do not meet the conditions of the Promotion in the shopping center:

- which were received during purchases that were not made during the Promotion period in the mall (before 10:00 a.m. on 04/03/2024 or after 10:00 p.m. on 04/03/2024);

- issued in violation of the terms of these Rules.
5.5. The Customer can inform about the exact time or change of time of the Promotion in the shopping center on the official website of the shopping center https://lavinamall.ua/ and on the pages in the social networks of the Customer.

WARNING! The organizer and/or the Customer of the Promotion reserves the right to change the algorithm and time of the Promotion in the mall.

In the event of an air alert in the city of Kyiv and/or the Kyiv region, the promotion in the shopping center will be suspended until the air alert is lifted. In the event of a long-term air alarm, the Promotion in the shopping center may be postponed to another day.

The Customer can inform about the change of the day/time of the Promotion in the shopping center on the official website of the shopping center https://lavinamall.ua/ and on the pages in the social networks of the Customer.

6. Conducting the Promotion online

6.1. Prizes Promotions are played online on the Instagram page (https://www.instagram.com/lavinamall.ua/) from 12:00 p.m. until 10:00 p.m. April 3, 2024.

6.2. Who has the right to participate in the Promotion online?

• All citizens of Ukraine who permanently reside in Ukraine and who have reached the age of 18 at the start of the Promotion;
• Participants of the Online Promotion may be natural persons, provided that they fulfill the conditions of participation in the Promotion provided by these Rules.

6.3. The following are not recognized as participants of the online Promotion and are not entitled to participate in the online Promotion:

• persons who were under 18 years of age at the time of the Online Promotion;
• persons who have not fulfilled the conditions of these Rules;
• non-residents of Ukraine;
• owners and employees of the Customer/Organizer or representatives of the tenants of the "Lavyna" TRC (including, but not limited to: service personnel of the "Lavyna" TRC stores), owners and employees of other third parties involved in the Promotion and maintenance of the "Lavyna" TRC, in including advertising agencies, cleaning, security and other organizations, as well as immediate members of their families.
  6.4. To participate in the Promotion online, you need between March 30, 2024, from 1:00 p.m. to April 3, 2024, until 5:00 p.m.:

- subscribe to @lavinamall.ua;

- like the post;

- write in the comments which Inditex store you missed the most.

6.5. With the help of the Raffles service, at 17:00 two Winners of the Promotion will be selected online from among all those who have fulfilled the conditions specified in clause 6.4 of these Rules.

6.6. Winners can receive the Prize exclusively in person. The participant of the Online Promotion must be a person living in Kyiv or the Kyiv region.

6.7. Awarding of Prizes of the online Promotion takes place within 30 (thirty) calendar days after the online Promotion at the address: Kyiv, str. Berkovetska, 6D. The exact date and time of awarding the Prizes shall be agreed by the Winner with the Organizer.

6.8. During the presentation of Prizes of the Promotion online, the Winner must present to the Organizer:

• original/copy of passport and identification number.

and sign a statement confirming the receipt of the Prize and consent to the processing of personal data.

The online Promotion period can be changed by means of a notification on the official website of the shopping center https://lavinamall.ua/ and social media pages https://www.instagram.com/lavinamall.ua/.

7. Receiving Prizes

7.1. Promotional prizes can only be received in person.

7.2. Prize(s) Promotions are not refundable or exchangeable.

7.3. The Customer and the Organizer do not assume responsibility for any disputes regarding the Prize/Prizes, the Customer/Organizer does not enter into any disputes regarding the recognition of any person as a Participant/Winner and the rights to receive the Prize/Prizes. The Customer and the Organizer are not responsible for determining the rights of the parties in any disputes.

7.4. The Customer and the Organizer are not responsible in the event of force majeure, such as natural disasters, fire, flood, military actions of any nature, counter-terrorist operations, blockades, reports of landmines, significant changes in the legislation in force on the territory and in the period of the Promotion, other factors beyond the control of the Customer/Organizer of the Promotion, which make it impossible or difficult to perform duties, and do not depend on the will of the Customer/Organizer of the Promotion.

7.5. The Customer and/or the Organizer are not responsible for any expenses of the Participant/Winner related to receiving and further use of the Prize/Prizes.

7.6. The Customer and the Organizer have the right to:

deny participation in the Promotion to a person who has not fulfilled/improperly fulfilled all the conditions for participation in the Promotion specified in these Rules;
refuse to issue the Prize/Prizes to the Winner who has not fulfilled the conditions necessary for receiving such Prize/Prizes, according to these Rules.
7.7. The Customer and the Organizer bear no responsibility for the reliability of the information provided by the Participants of the Promotion, including contact information with them.

7.8. When receiving the relevant Prize, the Participant/Winner signs with the Customer/Organizer of the Promotion a statement confirming receipt of the Prize, and consent to the processing of personal data, the forms of which are determined by the Customer/Organizer of the Promotion, on the basis of which the Participant/Winner receives the Prize.

7.9. Refusal of the Participant/Winner from receiving the Prize and/or from signing the Confirmation Application, as well as providing it later than the specified period or providing information that has signs of falsification or is unreliable/incorrect, deprives the Participant/Winner of the right to receive the Prize and is considered a refusal by the Participant /Winner  from receiving the Prize.

7.10. If the Participant/Winner is unable/willing to use/receive the Prize for reasons beyond the control of the Customer/Organizer of the Promotion, the Customer/Organizer shall not pay the Participant/Winner any compensation related to such inability to use/receive the Prize.

7.11. Replacement of the Prize with other goods/services is not allowed.

8. OTHER TERMS

8.1. The Customer/Organizer of the Promotion reserves the right to change these Rules, the date and time of the Promotion, other conditions. Information about the changed date of the Promotion or the determination of Participants/Winners can be found on the official website: https://lavinamall.ua/

8.2. The Customer/Organizer of the Promotion is not responsible for the impossibility of receiving the Prize by the Participant/Winner for any reason beyond the control of the Customer/Organizer of the Promotion, including due to the Participant/Winner specifying incorrect/or incomplete data, etc., which are necessary for taking part in the Promotion, sickness, leave of the Participant/Winner, interruptions in the work of Ukrainian communication operators, etc. At the same time, such a Participant/Winner is deprived of the right to receive any compensation from the Customer/Organizer.

8.3. The Customer/Organizer of the Promotion is not responsible for the future use of the Prizes.

8.4. The Participant/Winner agrees that in case of receiving the Prize, his personal data, which were provided to the Customer/Organizer of the Promotion, as well as the recording of the process of awarding the Prize itself, may be used in printed, audio and video materials without additional special consent of the Participant/Winner, and such use is not compensated in any way to the Participant/Winner.

8.5. In the event of a situation that implies an ambiguous interpretation of these Rules, any disputed issues and/or issues not regulated by these Rules, the final decision is made by the Customer/Promotion Organizer. The decision of the Customer/Promotion Organizer is final and not subject to appeal.

8.6. The fact of filling out the Participant's Questionnaire means the Participant's full consent to all provisions of the Official Terms of the Promotion, as well as consent to the use, storage and processing of their personal data in accordance with the Law of Ukraine "On the Protection of Personal Data", to their transfer to third parties, with marketing and/or for any other purpose, by methods that do not contradict the current legislation of Ukraine (including by transferring it to third parties), in particular, for the free use of his name, surname, image (photo or video), interview or other materials about him for advertising purposes, including the right to publish his name and image (photo or video) in the mass media, any printed, audio and video materials, interviews with the mass media, without limitation on the territory and term of such use, and such use is not compensated (paid) by the Organizer, the Customer or third parties. Also, it is considered that the Participant has given his consent to the use of his name and image within the meaning of Art. 296, 307, 308 of the Civil Code of Ukraine.

Participants are familiarized with their rights provided for in Art. 8 of the Law of Ukraine "On Protection of Personal Data".

8.7. In cases where the Organizer, while fulfilling the obligations assumed within the scope of this Promotion, carries out any operations that are subject to taxation in accordance with the legislation of Ukraine, the Organizer ensures the payment of all taxes, fees and mandatory payments provided for by the current legislation of Ukraine. including personal income tax; preparation and submission of relevant tax reporting. Taking into account the terms of this clause, the Participant/Winner agrees that payment by the Organizer of relevant taxes, fees and mandatory payments, including personal income tax, does not exempt the Participant/Winner, in accordance with Article 67 of the Constitution of Ukraine and Article 179 of the Tax Code of Ukraine, from submitting an annual declaration on one's property status and income for the past year.

8.8. The rules are approved by the Customer/Organizer of the Promotion and are valid for the duration of the Promotion.
