RULES OF PARTICIPATION IN THE PROMOTION

“Together we can do anything! We donate 100,000 hryvnias - we appreciate your help!”

(hereinafter referred to as “Official Terms” or “Rules”)

• The Promotion is held in accordance with the terms of these Rules (Official Terms).
• The Customer and the Organizer are not responsible for the Participant’s failure to familiarize themselves with these Rules.

1. Customer, Organizer and Partners of the Promotion

1.1. The Customer of the Promotion entitled “Together we can do anything! We donate 100,000 hryvnias - we appreciate your help!” (hereinafter referred to as “Promotion”) is the LIMITED LIABILITY COMPANY “LAVINA SHOPPING CENTER”, taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 38537759.

1.2. The organizer of the Promotion is:

- LIMITED LIABILITY COMPANY "KET Media Production", taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 45458168;

- LIMITED LIABILITY COMPANY "PROFI EDZ" taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 40895333.

1.3. The Partner of the Promotion 1 is LIMITED LIABILITY COMPANY "Markholder", taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 42772934 (trademark "Ukrzoloto").

1.4. The Partner of the Promotion 2 is  INDIVIDUAL PERSON - ENTREPRENEUR YEVCHUK OLENA ANATOLIIVNA, taxpayer registration card number 2587418107,

1.5. The Partner of the 3rd Promotion is the LIMITED LIABILITY COMPANY "JEWELRY COMPANY "ZOLOTYY VIK", taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 45509992.

1.6. The Partner of the 4th Promotion is the INDIVIDUAL PERSON - ENTREPRENEUR SAVCHENKO ARTEM KOSTYANTYNOVYCH, taxpayer registration card number 3451911010.

2. Prize Fund of the Promotion

2.1. The prize fund of the Promotion is limited.

Prizes of the Promotion:

Gift certificates of the trademark "UKRZOLOTO" in the amount of 100,000 (one hundred thousand hryvnias) UAH. with a face value of 5,000.00 UAH (five thousand UAH. 00 kopecks) - in the amount of 20 pieces.

Gift certificates can be used exclusively for the purchase of jewelry in the stores of the jewelry chain of the trademark "UKRZOLOTO".

The transfer of the prize fund means the sale of gift certificates to the winners for 0.10 UAH. per 1 piece.

2.2. The Customer and the Organizer of the Promotion ensure the organization and conduct of the Promotion. Partner 2, Partner 4 and/or third parties involved by them ensure the transfer/presentation of the Promotion prizes to the Winners of the Promotion. The transfer of the prize fund means the sale by Partner 4 of the Promotion to the winners of gift certificates for UAH 0.10 per 1 piece at the location of the Promotion.

2.3. Partner 3 of the Promotion ensures that the winners can use the Prizes of the Promotion received by them in the jewelry chain of the UKRZOLOTO trademark.

2.4. The Prizes of the Promotion can be received by the Winners of the Promotion only on the terms specified in these Rules.

2.5. The appearance and content of the Prizes of the Promotion may differ from their images in the promotional materials of the Promotion, and may not meet the expectations of the Participants of the Promotion.

ATTENTION! This Promotion is not a game of chance, lottery, service in the field of gambling business, or a competition, and these Rules are not a public promise of a reward or the conditions of the competition.

3. Main provisions of the Promotion in the shopping mall

3.1. The Promotion is held on the territory of the Lavina Shopping and Entertainment Center, located at: Kyiv, Berkovetska Street, 6D (hereinafter referred to as the Shopping Mall), and will last from 10:00 a.m. on February 1, 2025 to 5:00 p.m. on March 8, 2025 inclusive (hereinafter referred to as the “Promotion Period”).

The Promotion Period in the Shopping Mall may be changed by notification on the official website of the Shopping Mall https://lavinamall.ua/ and the Customer’s social media pages.

3.2. Who is eligible to participate in the Promotion in the Shopping Mall?

• All citizens of Ukraine who permanently reside in Ukraine and who are 18 years old at the time of the Promotion in the Shopping Mall;
• Participants of the Promotion in the shopping mall may be individuals, provided that they fulfill the conditions for participation in the Promotion in the shopping mall, as stipulated in these Rules.

3.3. The following are not recognized as participants of the Promotion in the shopping mall and are not entitled to participate in the Promotion in the shopping mall:

• persons who are under 18 years of age at the time of the Promotion in the shopping mall;
• persons who have not fulfilled the conditions of these Rules;
• non-residents of Ukraine;
• owners and employees of the Customer/Organizer/Partner or representatives of the tenants of the shopping mall "Lavyna" (including, but not limited to: service personnel of the shopping mall "Lavyna"), owners and employees of other third parties involved in the Promotion and servicing the shopping mall "Lavyna", including advertising agencies, cleaning, security and other organizations, as well as immediate members of their families.

4. Goods, the purchase of which entitles you to participate in the Promotion in the shopping mall

4.1. A mandatory condition for participation in the Promotion in the shopping mall is the purchase of goods on the territory of the shopping mall "Lavina" (hereinafter referred to as the "Goods"). The list and location of stores, the purchase of goods in which entitles you to participate in the Promotion in the shopping mall, can be found on the shopping mall website https://lavinamall.ua/ or directly in the shopping mall at information stands/stands.

5. Terms and procedure for participation in the Promotion in the shopping center

5.1. To acquire the status of a Participant of the Promotion in the shopping center, it is necessary:

5.1.1. Make a purchase of Goods for the amount of UAH 1,500.00 or more (one thousand five hundred hryvnias 00 kopecks) with one payment document (cash receipt, merchandise receipt, expense receipt, payment receipt confirming the fact of sale (purchase) of Goods, and registered in the prescribed manner by the registrar of settlement operations or the software registrar of settlement operations, or filled in manually), which must clearly indicate the place (address) of purchase, date and amount of purchase in any store on the territory of the shopping center, with the exception of the Silpo supermarket, or make a purchase of Goods in the Silpo supermarket for the amount of UAH 4,000.00 or more. (four thousand hryvnias 00 kopecks) in one payment document, which must clearly indicate the place (address) of purchase, date and amount of purchase.

5.1.2. Register a payment document confirming the purchase that meets the terms of the Promotion in the shopping mall by filling out the Questionnaire at the promotional registration desk in the shopping mall "Lavyna" near the stage.

5.2. The Participant of the Promotion in the shopping mall can register by filling out the Questionnaire independently or with the help of promoters, at the promotional desk on the territory of the shopping mall "Lavyna".

Schedule of the promotional desk and promoters:

Daily at the following hours:

• in the period from 01.02.2025 to 14.02.2025 inclusive:

Mon.-Fri.: from 14.00 to 20.00;

Sat.-Sun.: from 12.00 to 20.00;.

02/15/2025: from 12.00 to 17.00

• in the period from 02/16/2025 to 03/07/2025 inclusive:

Mon.-Fri.: from 14.00 to 20.00;

Sat.-Sun.: from 12.00 to 20.00;.

03/08/2025: from 12.00 to 17.00

5.3. The form is filled out by entering information about the Participant necessary for participation in the Promotion in the shopping mall, namely: Surname, first name, patronymic, check amount, date of purchase, name of the store where the purchase was made, e-mail, phone number.

5.4. The Participant who has fulfilled the terms of the Promotion in the shopping mall takes part in the draw for Prizes from the Partner.

Only settlement documents (checks) of the Participant of the Promotion in the shopping mall with the date and time corresponding to the period of the Promotion in the shopping mall and for which registration in the Promotion in the shopping mall has been carried out, in accordance with the terms of these Rules, are allowed to participate in the Promotion in the shopping mall.

The following payment documents (fiscal or merchandise receipts) do not comply with the terms of the Promotion in the shopping center:

- which were received during purchases that were made outside the Promotion Period in the shopping center (before 14:00 on 01.02.2025 and after 17:00 on 08.03.2025);

- issued in violation of the terms of these Rules.

5.5. One Participant has the opportunity to register an unlimited number of receipts for participation in the Promotion in the shopping center during the entire Promotion period in the shopping center, provided that all terms of these Rules are met.

5.6. By participating in the Promotion in the shopping center, Participants of the Promotion in the shopping center thereby confirm the fact of familiarization with these Promotion Rules and their full and unconditional agreement with them.

5.7. By participating in the Promotion, the Participants of the Promotion in the Shopping Center voluntarily agree to provide the Organizer of the Promotion with information (including personal data) determined by the Customer and the Organizer of the Promotion as necessary to receive the corresponding Promotion Prize.

5.8. Violation by the Participants of the Promotion of these Rules or refusal by the Participants of the Promotion to properly comply with these Rules (including the conditions specified in these Rules, the procedure and terms for holding the Promotion and/or receiving the Promotion Prizes, etc.) is considered a refusal of the Participant to participate in the Promotion. In this case, such a person does not have the right to receive any compensation from the Customer and the Organizer of the Promotion and/or third parties involved by them.

5.9. Participants of the Promotion in the shopping mall must keep the originals of the payment documents (checks) for the Goods on the basis of which they participate in the Promotion in the shopping mall, to confirm the purchase in the shopping mall "Lavyna" during the Promotion period.

5.10. The Customer and/or the Organizer of the Promotion has the right to require the Participant of the Promotion to present the originals of the payment and other documents for the Goods participating in the Promotion in the shopping mall at any time at its discretion.

5.11. The Customer and/or the Organizer of the Promotion have the right, and the Winner is obliged to provide for verification the originals of the payment and other documents and other information provided for by these Rules, within 14 days from the moment of determining the Winner.

6. Prize Draw within the Promotion

6.1. The Winners of the Promotion will be determined by conducting 2 (two) draws:

The first draw for Valentine's Day, which will determine three Winners, will be held on February 15, 2025 from 3:00 p.m. to 6:00 p.m.:

- the first Winner will receive certificates in the amount of 10,000.00 hryvnias (ten thousand hryvnias 00 kopecks);

- the second Winner will receive certificates in the amount of 20,000.00 hryvnias (twenty thousand hryvnias 00 kopecks);

- the third Winner will receive certificates in the amount of 20,000.00 hryvnias (twenty thousand hryvnias 00 kopecks).

Attention! The Prize Draw ends at 6:00 p.m. February 15, 2025 or (in case of change) on the day and time specified on the official website of the shopping center https://lavinamall.ua/ and/or on the pages of the Customer's social networks as the end time of the draw.

The second draw for International Women's Day, at which three Winners will be determined, will be held on March 08, 2025 from 3:00 p.m. to 6:00 p.m.:

- the first Winner will receive certificates in the amount of 10,000.00 hryvnias (ten thousand hryvnias 00 kopecks);

- the second Winner will receive certificates in the amount of 20,000.00 hryvnias (twenty thousand hryvnias 00 kopecks);

- the third Winner will receive certificates in the amount of 20,000.00 hryvnias (twenty thousand hryvnias 00 kopecks).

Attention! The Prize Draw ends at 6:00 p.m. March 8, 2025 or (if changed) on the day and time indicated on the official website of the shopping center https://lavinamall.ua/ and/or on the Customer's social media pages as the end time of the draw.

6.2. The Customer may report the exact time or change of the date and time of any draw within the Promotion on the official website of the SEC https://lavinamall.ua/ and/or on the Customer's social media pages.

6.3. The Winners of the Promotion will be determined by the Organizer at random by drawing lots among all registered Participants participating in the Promotion. The drawing will take place as follows:

6.3.1. The Organizer (the host of the draw) using a lottery machine that will contain the registered Questionnaires of the registered Participants of the Promotion, by "blind" drawing (selection of Questionnaires without prior review of their content) selects the appropriate number of Winners of the Promotion.

6.3.2. The Participant of the Promotion whose Questionnaire is determined to have won the Prize will be notified of this immediately at the place of the draw on the day of the draw by verbal announcement.

6.3.3. The presence of the Participant of the Promotion at the place of the Prize draw is a mandatory condition for receiving the Prize.

6.3.4. If the Participant of the Promotion, whose Questionnaire is determined to have won the Prize, does not confirm his presence at the place of the draw (lotto machine) within 5 (five) minutes from the moment of the relevant announcement, the Organizer (the person conducting the draw) must call him once at the phone number indicated in the Questionnaire.

6.3.5. If the Participant of the Promotion does not pick up the phone or, having picked up the phone, does not confirm his participation in the Promotion and presence in the LAVINA Shopping Center, or refuses to receive the Prize, or does not fulfill the requirements of these Terms and Conditions, he loses the right to receive the Prize, and the Prize may be re-drawn among other Participants at random, by drawing lots among all other Questionnaires, or the Organizer may keep such a prize for the draw during the next Promotion.

6.3.6. If a Questionnaire belonging to an already selected Participant is pulled from the lottery machine, such Questionnaire is not taken into account on the day of this particular draw, but such Participant (Participant's Questionnaire) has the right to participate in the next draw of this Promotion. The Questionnaire belonging to an already selected Participant is removed from the lottery machine for the time of this particular draw, and the draw is carried out again in accordance with these Rules.

6.3.7. If the Participant whose Questionnaire was drawn from the lottery machine does not appear at the place specified by the Organizer, another Winner will be selected by drawing lots.

6.3.8. If the Participant has fulfilled all the conditions stipulated by these Rules, he/she is declared the Winner and is entitled to the Prize.

Attention! The Organizer and/or the Customer of the Promotion reserves the right to change the algorithm and time of any draw and determine the Winners.

In the event of an air raid warning in the city of Kyiv and/or Kyiv region, the draw is suspended until the air raid warning is lifted and resumed after the air raid warning is lifted. In the event of a long-term air raid warning, the draw may be postponed to another day, which will be announced on the official website of the shopping mall https://lavinamall.ua/ and/or on the Customer's social media pages.

In the event of an air raid warning that lasts more than 3 hours in a row, the Customer and/or the Organizer of the Promotion reserve the right to hold the Prize draw online on the Instagram page. https://www.instagram.com/lavinamall.ua?igsh=M2Fwa2N6MXhzaHFz. In this case, changes to the terms of the draw will be announced additionally on the official website of the shopping mall https://lavinamall.ua/ and/or on the Customer's social media pages.

6.4. The Winners will be notified of their victory in the Promotion immediately during the draw.
6.5. The Prizes are awarded after the draw.

6.6. The Prize is received by the Winner by the Organizer on the central stage of the shopping mall on the day of the event.

6.7. From the moment the Winners receive the Prizes, the obligations of the Customer and the Organizer to transfer the Prizes are considered fulfilled in full.

6.8. The Organizer and the Customer are not responsible for the impossibility of awarding the Prize to the Winner due to the latter's refusal to undergo the inspection specified in these Official Terms and Conditions.

6.9. The Prize is awarded to the Winner of the Promotion by the Organizer of the Promotion. The award of the prize means its sale for 0.10 UAH, which is carried out by the Partner 4 of the Promotion.

6.10. The Customer/Organizer/Partner 1/Partner 2/ for the award of the Prizes have the right to request from the Winners:

• Original/copy of passport or documents that identify the person and confirm citizenship of Ukraine and a certificate of assignment of the registration number of the taxpayer's account card;
• the original of the payment document that was registered in the Promotion, exclusively for familiarization and verification of compliance by the Participant with all the terms of the Promotion.

6.11. The Winner of the Promotion has the opportunity to receive the Prize after verification by the Customer and/or the Organizer and/or Partner 2 of the original payment document specified by the Winner when registering for the Promotion, as well as upon providing a copy of documents that identify the person and confirm the citizenship of Ukraine and a certificate of assignment of the registration number of the taxpayer's account card (provided that the Winner does not apply for the return of the quality Goods according to the payment document (check), which became the basis for determining the Winner, in accordance with the requirements of Article 9 of the Law of Ukraine "On Protection of Consumer Rights") and signing a statement confirming receipt of the Prize and consent to the processing of personal data. In the event that the Winner submits an application for the return of the Goods according to the payment document, which became the basis for determining the Winner, within the terms specified by the legislation of Ukraine, the Winner loses the right to receive the Prize.

6.12. The Customer and the Organizer have the right:

• to refuse participation in the Promotion to a person who has not fulfilled/improperly fulfilled all the conditions for participation in the Promotion specified in these Rules;
• to refuse to issue the Prize/Prizes to the Winner who has not fulfilled the conditions necessary to receive such Prize/Prizes, in accordance with these Rules.

6.13. The Customer and the Organizer do not bear any responsibility for the reliability of the information provided by the Participants of the Promotion, including information regarding their contacts.

6.14. When receiving the relevant Prize, the Winner signs with the Customer/Organizer of the Promotion a statement confirming receipt of the Prize and consent to the processing of personal data, the forms of which are determined by the Customer/Organizer of the Promotion.

6.15. The Winner's refusal to receive the Prize and/or refusal to sign the proposed documents stipulated by these Rules, including the provision of these documents later than the specified deadline, or the provision of information that has signs of fictitiousness or is unreliable, deprives the Winner of the right to receive the Prize and is considered the Winner's refusal to receive the Prize.

6.16. In the event that the Winner is unable/unwilling to use/receive the Prize for reasons beyond the control of the Customer/Promotion Organizer, the Customer/Promotion Organizer shall not pay the Winner any compensation related to such inability to use/receive the Prize.

6.17. Replacement of Prizes with other goods/services is not allowed.

7. Receiving the Prizes by the Winners

7.1. The Winners may receive the Prize only in person.

7.2. The Prize(s) of the Promotion are not returnable or exchangeable.

7.3. The Customer and the Organizer shall not be liable for any disputes regarding the Prize(s), the Customer/Organizer shall not enter into any disputes regarding the recognition of any persons as Participants/Winners and the rights to receive the Prize(s). The Customer and the Organizer shall not be liable for determining the rights of the parties in any disputes.

7.4. The Customer and the Organizer are not liable in the event of force majeure circumstances, such as natural disasters, fire, flood, military actions of any nature, blockades, significant changes in legislation in force in the territory and during the Promotion period, other circumstances beyond the control of the Customer/Organizer of the Promotion.

7.5. The Customer and/or the Organizer are not liable for any expenses of the Winner related to the receipt and further use of the Prize/Prizes.

7.6. The Customer and the Organizer have the right:

• to refuse participation in the Promotion to a person who has not fulfilled/improperly fulfilled all the conditions for participation in the Promotion specified in these Rules;
• to refuse to issue the Prize/Prizes to a Winner who has not fulfilled the conditions necessary to receive such Prize/Prizes, in accordance with these Rules.

7.7. The Customer and the Organizer do not bear any responsibility for the accuracy of the information provided by the Participants of the Promotion, including information regarding their contacts.

7.8. When receiving the relevant Prize, the Winner signs with the Customer/Organizer of the Promotion a statement confirming receipt of the Prize and consent to the processing of personal data, the forms of which are determined by the Customer/Organizer of the Promotion.

7.9. The Winner's refusal to receive the Prize and/or refusal to sign the proposed documents provided for by these Rules, including the provision of these documents later than the specified deadline, or the provision of information that has signs of fictitiousness or is unreliable, deprives the Winner of the right to receive the Prize and is considered the Winner's refusal to receive the Prize.

7.10. If the Winner is unable/unwilling to use/receive the Prize for reasons beyond the control of the Customer/Organizer of the Promotion, the Customer/Organizer shall not pay the Winner any compensation related to such inability to use/receive the Prize.

7.11. Replacement of the Prize with other goods/services is not allowed.

8. OTHER CONDITIONS

8.1. The Customer/Organizer of the Promotion reserves the right to change these Rules, the date and time of any draw/draws and the determination of the Winner, other conditions. Information about changes can be found on the official website: https://lavinamall.ua/

8.2. The Customer/Organizer of the Promotion is not responsible for the inability of the Winner to receive the Prize for any reasons beyond the control of the Customer/Organizer of the Promotion, including due to the Winner indicating (providing) incorrect (untrue) and/or incomplete data, etc., which are necessary for participation in the Promotion, including the Winner's reference to illness, vacation, interruptions in the work of Ukrainian telecommunications operators, etc. In this case, such a Winner is deprived of the right to receive any compensation from the Customer/Organizer.

8.3. The Customer/Promotion Organizer is not responsible for the future use of the Prizes.

8.4. The Winner agrees that in the event of receiving the Prize, his/her personal data provided to the Customer/Promotion Organizer, as well as the recording of the Prize awarding process itself, may be used in printed, audio and video materials without additional special consent of the Winner, and such use shall not be paid to the Winner in any way.

8.5. The Customer/Promotion Organizer shall not be liable for failure to hold the Promotion or for failure to award the Prize in the event of force majeure circumstances (including natural disasters, fires, floods, military actions of any nature, blockades, terrorist attacks, reports of mining, significant changes in the current legislation in force in the territory of the Promotion during the Promotion period, etc.) or other circumstances that make it impossible or difficult to fulfill obligations and do not depend on the will of the Customer/Promotion Organizer.

8.6. In the event of a situation that suggests an ambiguous interpretation of these Rules, any controversial issues and/or issues not regulated by these Rules, the final decision shall be made by the Customer/Promotion Organizer. The decision of the Customer/Promotion Organizer is final and cannot be appealed.

8.7. The fact of filling out the Participant's Questionnaire means that the Participant fully agrees with all provisions of the Official Terms of the Promotion, as well as consent to the use, storage and processing of their personal data in accordance with the Law of Ukraine "On Protection of Personal Data", to their transfer to third parties, for marketing and/or any other purpose, by methods that do not contradict the current legislation of Ukraine (including by transfer to third parties), in particular, to the free use of their name, surname, image (photo or video), interview or other materials about them for advertising purposes, including the right to publish their name and image (photo or video) in the media, any printed, audio and video materials, interviews with the media, without restrictions on the territory and term of such use, and such use is not compensated (not paid) by the Organizer, Partner, Customer or third parties. It is also considered that the Participant has consented to the use of his/her name and image within the meaning of Articles 296, 307, 308 of the Civil Code of Ukraine.

The Participants are familiar with their rights under Article 8 of the Law of Ukraine “On Protection of Personal Data”.

8.8. In cases where the Partner, in fulfilling the obligations undertaken within the framework of this Promotion, carries out any transactions that are subject to taxation in accordance with the legislation of Ukraine, the Partner ensures the payment of all taxes, fees and mandatory payments provided for by the current legislation of Ukraine, including personal income tax; preparation and submission of relevant tax reporting. Taking into account the terms of this clause, the Winner agrees that the payment by the Partner of relevant taxes, fees and mandatory payments, including personal income tax, does not exempt the Winner, in accordance with Article 67 of the Constitution of Ukraine and Article 179 of the Tax Code of Ukraine, from submitting an annual declaration of their property status and income for the past year.

8.9. The Rules are approved by the Customer/Organizer of the Promotion and are valid for the duration of the Promotion.
