RULES FOR PARTICIPATION IN THE PROMOTION "LAVINA MALL CELEBRATES BIRTHDAY AND...GIVES 500,000 HRYVNA FOR SHOPPING! WE ARE WAITING, GATHERING FOR THE IMPORTANT"

(hereinafter referred to as "Official Terms" or "Rules")

• The promotion is conducted in accordance with the terms of these Rules (Official Terms).
• The Customer and the Organizer are not responsible for not familiarizing the Participant with these Rules.

1. Customer and Organizer of the Promotion
1.1. The customer of the Promotion called "LAVINA MALL CELEBRATES BIRTHDAY AND...GIVES 500,000 HRYVNA FOR SHOPPING! WE WAIT, WE COLLECT FOR THE IMPORTANT" (hereinafter - the "Action") is the LIMITED LIABILITY COMPANY "TRC LAVINA", taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 38537759.

1.2. The organizer of the Promotion is KET MEDIA PRODUCTION LIMITED LIABILITY COMPANY, taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine is 45458168.

2. Prize Fund Actions
2.1. Prizes:

2.1.1. Gift certificate for the amount of UAH 100,000.00 – 5 pcs.;

2.3. The prize fund of the Promotion is limited to the number of Prizes defined in clause 2.1 of these Rules.

2.4. The customer provides:

- transfer/handover of Prizes to the Winners of the Action;

- compliance with the requirements of Ukrainian legislation in terms of taxation of received Prizes.

2.5. The organizer of the Promotion ensures the organization and conduct of the Promotion in accordance with the terms of these Rules.

2.6. Prizes can be received by the participants of the Promotion only under the conditions specified in these Rules.

2.7. The appearance and content of the Prizes may differ from their images on the promotional materials of the Promotion, and may not meet the expectations of the Promotion Participants.

2.8. A total of 5 (five) Winners are possible in the Promotion, who can receive Prizes. At the same time, 1 (one) Winner can receive only one Prize. Prizes, namely gift certificates (hereinafter referred to as Certificates) are defined in Clause 2.1.1 of these Rules.

2.8.1. The winners of the Promotion have the right to exchange the Certificate for the available Product exclusively in the "Citrus" store, which is located on the territory of the "LAVINA" Shopping Center. 2.8.2. If the value of the goods received by the Winner is less than the amount of the Gift Certificate defined in clause 2.1.1 of these Rules, the difference between the amount of the Certificate and the value of the goods received is not subject to compensation to the Winner.

2.8.3. If the value of the product is greater than the amount of the Gift Certificate defined in Clause 2.1.1 of these Rules, the Winner has the right to exchange the Certificate for a product, subject to additional payment of the difference between the amount of the Certificate and the value of the selected product.

2.8.4. The winner cannot exchange the gift certificate for cash.

WARNING! This Promotion is not a game of chance, lottery, gaming service, or contest, and these Rules are not a public promise of reward or contest terms.

3. Basic provisions of the Promotion
3.1. The promotion is held on the territory of the shopping and entertainment center "LAVINA", located at the address: m. Kyiv, Berkovetska Street, 6D (hereinafter also referred to as "LAVINA" shopping center or shopping center), which will last from 2:00 p.m. November 8, 2024 at 5:00 p.m. 08.12.2024 inclusive (hereinafter referred to as the "Period of the Promotion").

The period of the Promotion may be changed by notification on the official website of the shopping center https://lavinamall.ua/ and the Customer's social media pages.

3.2. Who has the right to participate in the Promotion?

• All citizens of Ukraine who permanently reside in Ukraine and who have reached the age of 18 at the start of the Promotion;
• Participants of the Promotion may be natural persons, provided they fulfill the conditions of participation in the Promotion provided by these Rules.

3.3. The following are not recognized as participants of the Promotion and do not have the right to participate in the Promotion:

• persons who have not reached the age of 18 at the time of the Promotion;
• persons who have not fulfilled the conditions of these Rules;
• non-residents of Ukraine;
• owners and employees of the Customer/Organizer or representatives of the tenants of the "LAVINA" Shopping Center (including, but not limited to: store staff of the "LAVINA" Shopping Center), owners and employees of other third parties involved in the Promotion and maintenance of the "LAVINA" Shopping Center, in including advertising agencies, cleaning, security and other organizations, as well as members of their families (husband (wife) and children who have reached the age of majority; as well as all cohabitants, including cohabitants, but not married).

4. Products, the purchase of which gives the right to participate in the Promotion
4.1. A mandatory condition for participation in the Promotion is the purchase of goods in the territory of the "LAVINA" shopping center (hereinafter - "Goods"). The list and location of stores, the purchase of Goods in which the right to participate in the Promotion can be found on the shopping center website https://lavinamall.ua/ or directly in the shopping center at information counters/stands.

5. Conditions and procedure for participation in the Promotion
5.1. In order to acquire the status of a Participant of the Promotion, it is necessary during the period of the Promotion:

5.1.1. Make a purchase of Goods in the amount of UAH 1,000.00 or more. (one thousand hryvnias 00 kopecks) by one settlement document (cashier's check, goods receipt, expense check, settlement receipt confirming the fact of sale (purchase) of Goods, and registered in the prescribed manner by the registrar of settlement transactions or software registrar of settlement transactions, or filled out manually) which must clearly indicate the place (address) of the purchase, the date and amount of the purchase in any store on the territory of the shopping mall, with the exception of the "Silpo" supermarket;

5.1.2. Make a purchase of Goods in the amount of UAH 4,000.00 or more. (four thousand hryvnias 00 kopecks) by one settlement document, which must clearly indicate the place (address) of the purchase, the date and amount of the purchase in the "Silpo" supermarket;

5.1.3. Register settlement documents in accordance with the terms of these Rules.

5.2. Registration of settlement documents confirming the purchase of Goods and services is carried out by filling out the Questionnaire at the registration desk (promo desk) in the "LAVINA" Shopping Center near the stage.

5.3. The Participant of the Promotion fills out the Questionnaire independently or with the help of promoters at the promo counter on the territory of the "LAVINA" Shopping Center.

The working schedule of the promo counter and promoters:

Every day at the following hours:

• in the period from 08.11.2024 to 08.12.2024 inclusive:

Mon.-Fri.: from 2 p.m. until 8:00 p.m.;

Sat.-Sun.: from 12:00 p.m. until 8:00 p.m.;

• 12.2024: from 12:00 p.m. until 5:00 p.m.

5.4. Procedure for registration of Promotion Participants

5.4.1. The questionnaire is filled out by entering the following information about the Participant, namely:

Surname, first name, patronymic, amount of the settlement document, date of purchase, name of the store where the Product was purchased, service, e-mail address, phone number.

5.4.2. After filling out the questionnaire, the Participant hands it over to the promoter, who must check if the Participant has an original settlement document for the amount specified in these Rules.

5.4.3. After receiving the Questionnaire, checking the original of the settlement document, the promoter provides the Participant with the root of the questionnaire with the attached original of the settlement document.

5.4.4. From the moment the Participant receives the root of the Questionnaire with the attached original settlement document, the Participant is considered registered to participate in the Promotion.

5.5. A participant who has fulfilled the conditions specified in clause 5.4 can take part in the Prize draw.

5.6. Terms of participation in the Promotion

5.6.1. The Participant has the right to take part in the Prize drawing only on the condition of personal presence at the drawing and having with him the root of the application form with the attached original of the settlement document and a document certifying the identity and confirming the citizenship of Ukraine in accordance with the current legislation of Ukraine.

5.6.2. Only payment documents (cheques) of the Participant of the Promotion with the date and time corresponding to the period of the Promotion and for which the registration in the Promotion has been made, in accordance with the terms of these Rules, are allowed to participate in the Promotion.

5.6.3. The Organizer's representatives can check the presence of the participant specified in p. 5.6.1 documents.

5.6.4. The Participant receives the Prize personally.

5.7. The following settlement documents do not meet the conditions of the Promotion:

- for Goods and services that were not purchased during the Promotion Period (before 2:00 p.m. on November 8, 2024 and after 5:00 p.m. on December 8, 2024);

- settlement documents are drawn up in violation of the terms of these Rules.

5.8. One Participant has the opportunity to register an unlimited number of Questionnaires for each separate settlement document for participation in the Promotion during the entire period of the Promotion, provided that all conditions of these Rules are met.

5.9. By participating in the Promotion, the Participants of the Promotion thereby confirm the fact of familiarization with these Promotion Rules and their full and unconditional agreement with them.

5.10. Participants of the Promotion, participating in the Promotion, voluntarily agree to provide the Promotion Organizer with information (including personal data) determined by the Customer and the Promotion Organizer as necessary to receive the relevant Promotion Prize.

5.11. Violation by the Participants of the Promotion of these Rules or the refusal of the Participants of the Promotion to properly comply with these Rules (including the conditions specified in these Rules, the procedure and terms of the Promotion and/or receiving the Prizes of the Promotion, etc.) is considered a refusal of the Participant to participate in the Promotion and receive the Prize. At the same time, such a person does not have the right to receive any compensation from the Customer and the Promotion Organizer.

5.12. The participants of the Promotion must keep the original invoice documents for the Goods to confirm the purchase of the Goods in the "LAVINA" Shopping Center during the period of the Promotion.

5.13. The Customer and/or the Organizer of the Promotion has the right to demand from the Participant of the Promotion to present the originals of settlement and other documents and other information stipulated by these Rules, at any time at their discretion.

5.14. The Customer and/or the Organizer of the Promotion have the right, and the Winner is obliged to submit for verification the originals of settlement and other documents and other information provided by these Rules within 14 days from the moment of determining the winner.

6. Conducting the drawing of Prizes within the Promotion
6.1. The draw will be held on December 8, 2024 from 3:30 p.m. until 6:00 p.m. The customer has the right to change the dates and time of the draw.

6.2. The Customer can inform about the exact time or change of the date and time of the raffle within the Promotion on the official website of the shopping mall https://lavinamall.ua/ and/or on the Customer's social media pages.

WARNING! Prize draw ends at 6:00 p.m. December 8, 2024 or (if it is changed) on the day and time specified on the official website of the shopping center https://lavinamall.ua/ and/or on the Customer's social media pages as the end time of the draw.

6.3. The Winners of the Promotion will be determined by the Organizer based on random probability by drawing lots among all registered Participants participating in the Promotion. The draw will take place as follows:

6.3.1. The organizer (host of the drawing) will select the appropriate number of Winners of the Promotion using the lottery machine, which will contain the registered Questionnaires of the registered Participants of the Promotion, by means of a "blind" draw (choosing the Questionnaires without previewing their content).

6.3.2. The Participant of the Promotion, whose Questionnaire will be determined to have won the Prize, will be notified of this immediately at the location of the draw on the day of the draw by means of a verbal announcement.

6.3.3. The presence of the Promotion Participant at the location of the Prize drawing is a mandatory condition for receiving the Prize.

6.3.4. If the Promotion Participant, whose Questionnaire will be determined to have won the Prize, within 5 (five) minutes from the moment of the corresponding announcement, does not confirm his presence at the venue of the draw (lottotron), the Organizer (host of the draw) must call him once at the number phone number specified in the Questionnaire.

6.3.5. If the Promotion Participant does not pick up the phone or, having picked up the phone, does not confirm his participation in the Promotion and presence in the "LAVINA" shopping center, or refuses to receive the Prize, or does not fulfill the requirements of these Terms, he loses the right to receive the Prize, and the Prize can be re- drawn among other Participants at random probability, by drawing lots among all other Questionnaires, or the Organizer may keep such a prize for drawing during the next Promotion.

6.3.6. If a Questionnaire belonging to an already selected Participant is selected from the Lottotron, such Questionnaire is not taken into account and is removed from the Lottotron, and the drawing is carried out again in accordance with these Rules.

6.3.7. If the Participant, whose Questionnaire was drawn from the Lottotron, did not appear at the place indicated by the Organizer, another Winner will be chosen by lot.

6.3.8. If the Participant has fulfilled all the conditions stipulated by these Rules, he is declared the Winner and receives the right to the Prize.

WARNING! The Organizer and/or the Customer of the Promotion reserves the right to change the algorithm and the time of the draw and the determination of the Winners.

In the case of the announcement of an air alert in the city of Kyiv and/or the Kyiv region, the raffle is suspended until the air alert is lifted and resumes after the air alert is announced. In the event of a long-term air disturbance, the raffle may be postponed to another day, which will be announced on the official website of the shopping center https://lavinamall.ua/ and/or on the Customer's social media pages.

In the case of an air alarm lasting more than 3 hours in a row, the Customer and/or the Promotion Organizer reserve the right to hold a prize draw online on the Instagram page. https://www.instagram.com/lavinamall.ua?igsh=M2Fwa2N6MXhzaHFz. In this case, changes to the raffle conditions will be additionally announced on the official website of the shopping center https://lavinamall.ua/ and/or on the Customer's social media pages.

6.4. Winners will be notified of their victory in the Promotion immediately during the draw.
6.5. Prizes are awarded after the draw.

6.6. Receiving the Prize by the Winner is carried out by the Organizer presenting the Prize on the central stage of the shopping center on the day of the event.

6.7. From the moment the Winners receive the Prizes, the obligations of the Customer and the Organizer to transfer the Prizes are considered fulfilled in full.

6.8. The Organizer and the Customer are not responsible for the impossibility of awarding the Prize to the Winner due to the latter's refusal to pass the inspection specified in these Official Terms.

6.9. The Prize to the Winner of the Promotion is awarded by the Organizer of the Promotion.

6.10. The customer of the Promotion is recognized as a tax agent for the awarding of the Prizes, and undertakes to pay all relevant taxes and fees related to the awarding of the Prizes.

6.11. The Customer/Organizer for awarding the Prizes has the right to ask the Winners:

• Original/copy of documents certifying identity and confirming citizenship of Ukraine and a certificate of assignment of the registration number of the tax payer's registration card;
• the original settlement document that was registered in the Promotion, exclusively for familiarization and verification of the Participant's compliance with all the terms of the Promotion.

6.12. The winner of the Promotion has the opportunity to receive the Prize after the Customer and/or the Organizer has checked the original payment document specified by the Winner when registering for the Promotion, as well as on the condition of providing a copy of the identity document and confirming the citizenship of Ukraine and a certificate of assignment of the registration number of the taxpayer’s registration card (for the conditions of the absence of the Winner's application to return the high-quality Goods according to the settlement document (cheque), which became the basis for determining the Winner, in accordance with the requirements Article 9 of the Law "On the Protection of Consumer Rights") and signing the statement-confirmation of receipt of the Prize and consent to the processing of personal data. In the event that the Winner submits an application for the return of the Goods according to the settlement document, which became the basis for determining the Winner, within the terms specified by the legislation of Ukraine, the Winner loses the right to receive the Prize.

6.13. The Customer and the Organizer have the right to:

• deny participation in the Promotion to a person who has not/improperly fulfilled all the conditions for participation in the Promotion specified in these Rules;
• refuse to issue the Prize/Prizes to the Winner who has not fulfilled the conditions necessary for receiving such Prize/Prizes, according to these Rules.

6.14. The Customer and the Organizer bear no responsibility for the reliability of the information provided by the Participants of the Promotion, including contact information with them.

6.15. Upon receiving the relevant Prize, the Winner signs with the Customer/Organizer of the Promotion a statement confirming receipt of the Prize and consent to the processing of personal data, the forms of which are determined by the Customer/Organizer of the Promotion.

6.16. The Winner's refusal to receive the Prize and/or refusal to sign the proposed documents provided for in these Rules, including the submission of these documents after the specified deadline, or the provision of information that has signs of being fictitious or unreliable, deprives the Winner of the right to receive the Prize and is considered the Winner's refusal to receiving the Prize.

6.17. If the Winner is unable/willing to use/receive the Prize for reasons beyond the control of the Customer/Organizer of the Promotion, the Customer/Organizer shall not pay the Winner any compensation related to such inability to use/receive the Prize.

6.18. Replacement of Prizes with other Goods/services is not allowed.

7. OTHER TERMS
7.1. The Customer/Promotion Organizer reserves the right to change these Rules, the date and time of any raffle(s) and determination of the Winner, etc. Information about the changes can be found on the official website: https://lavinamall.ua/

7.2. The Customer/Organizer of the Promotion is not responsible for the inability of the Winner to receive the Prize for any reason beyond the control of the Customer/Organizer of the Promotion, including due to the fact that the Winner indicated (provided) incorrect (false) and/or incomplete data, etc., which are necessary for accepting participation in the Promotion, including the Winner's reference to illness, vacation, interruptions in the work of communication operators of Ukraine, etc. At the same time, such a Winner is deprived of the right to receive any compensation from the Customer/Organizer.

7.3. The Customer/Organizer of the Promotion is not responsible for the future use of the Prizes.

7.4. The Winner agrees that in case he receives the Prize, his personal data, which were provided to the Customer/Organizer of the Promotion, as well as the recording of the process of awarding the Prize itself, may be used in printed, audio and video materials without additional special consent of the Winner, and such use by no in this way the Winner is not paid.

7.5.The Customer/Organizer of the Promotion shall not bear any responsibility for failure to conduct the Promotion or award the Prize in the event of force majeure (including natural disasters, fires, floods, military operations of any nature, blockades, terrorist attacks, notices of landmines , significant changes in the current legislation in force in the territory of the event during the Promotion period, etc.) or other circumstances that make it impossible or difficult to implement duties, and do not depend on the will of the Customer/Organizer of the Promotion.

7.6. In the event of a situation that implies an ambiguous interpretation of these Rules, any disputed issues and/or issues not regulated by these Rules, the final decision is made by the Customer/Promotion Organizer. The decision of the Customer/Promotion Organizer is final and not subject to appeal.

7.7. The fact of filling out the Participant's Questionnaire means the Participant's full consent to all the provisions of the Official Terms of the Promotion, as well as consent to the use, storage and processing of their personal data in accordance with the Law of Ukraine "On the Protection of Personal Data", to their transfer to third parties, with marketing and/or for any other purpose, by methods that do not contradict the current legislation of Ukraine (including by transfer to third parties), in particular, for the free use of his name, surname, image (photo or video), interview or other materials about him for advertising purposes, including the right to publish his name and image (photo or video) in mass media, any printed, audio and video materials, interview with mass media, without limitation on the territory and term of such use, and such use is not compensated (paid) by the Organizer, the Customer or third parties. Also, it is considered that the Participant has given his consent to the use of his name and image within the meaning of Art. 296, 307, 308 of the Civil Code of Ukraine.

The participants of the Promotion are familiarized with their rights, provided for in Art. 8 of the Law of Ukraine "On Protection of Personal Data".

7.8. In cases where the Customer, while fulfilling the obligations undertaken within the scope of this Promotion, carries out any operations that are subject to taxation in accordance with the legislation of Ukraine, the Customer ensures the payment of all taxes, fees and mandatory payments provided for by the current legislation of Ukraine, including how a tax agent pays personal income tax; military collection, prepares and submits the relevant tax reporting. Taking into account the terms of this paragraph, the Winner agrees that the payment by the Customer of relevant taxes, fees and mandatory payments, including personal income tax and military duty, does not exempt the Winner, in accordance with Article 67 of the Constitution of Ukraine and Article 179 of the Tax Code of Ukraine, from submitting an annual declaration on one's property status and income for the past year in accordance with Article 67 of the Constitution of Ukraine and Article 179 of the Tax Code of Ukraine.

7.9. The rules are approved by the Customer/Organizer of the Promotion and are valid for the duration of the Promotion.
