RULES FOR PARTICIPATION IN THE PROMOTION

"HELP - ŠKODA KAMIQ WIN"

(hereinafter referred to as "Official Terms" or "Rules")

• The promotion is conducted in accordance with the terms of these Rules (Official Terms).
• The Customer and the Organizer are not responsible for not familiarizing the Participant with these Rules.

1. Customer, Organizer and Partner of the Promotion
1.1. The customer of the Promotion called "HELP - WIN ŠKODA KAMIQ" (hereinafter - the "Promotion") is the LIMITED LIABILITY COMPANY "TRAC LAVINA", taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 38537759.

1.2. The organizer of the Promotion is KET MEDIA PRODUCTION LIMITED LIABILITY COMPANY, taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine is 45458168.

1.3. The partners of the Action are:

EUROKAR LIMITED LIABILITY COMPANY, taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 32384621;

PUBLIC JOINT STOCK COMPANY "UKRNAFTA", taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine 00135390;

PUBLIC ORGANIZATION "WELFARE - VOLUNTEER CONSTRUCTION BATTALION", taxpayer code according to the Unified State Register of Enterprises and Organizations of Ukraine is 44859854.

2. Prize Fund Actions
2.1. Prizes:

2.1.1. ŠKODA KAMIQ SELECTION 1.0 TSI/85 kW 7DSG car, 2024 release – 1 pc.;

2.1.2 Fuel gasoline A-95 - 1000 liters.

2.2. Guaranteed gifts:

2.2.1. Universal charger Pocket 5000 mAh, TM TEG - 550 pcs.; 2.2.2. Umbrella-cane Snap, TM Discover 3 - 1000 pcs.;

2.2.3. Thermal bag lunch box - 1000 pcs.

2.3. The prize fund of the Promotion is limited to the number of Prizes and Guaranteed gifts specified in Clause 2.1 and Clause 2.2 of these Rules.

2.4. Guaranteed gifts are given to the Winners for each donation, the amount of which is a multiple of UAH 10.

2.5. The Customer and the Promotion Organizer and/or the third parties engaged by them ensure:

- transfer/handover of Prizes and Guaranteed gifts to the Winners of the Promotion;

- compliance with the requirements of the legislation of Ukraine in terms of taxation of received Prizes and Guaranteed gifts is ensured by the Partner in accordance with the requirements of the legislation of Ukraine.

2.6. Prizes and Guaranteed gifts can be received by the Winners of the Promotion only under the conditions specified in these Rules.

2.7. The appearance and content of the Prizes and Guaranteed Gifts may differ from their images on the promotional materials of the Promotion, and may not meet the expectations of the Promotion Participants.

2.8. A total of 2 (two) Winners are possible in the Promotion, who can receive a Prize, while 1 (one) Winner can receive only one Prize.

2.9. A total of 2,550 (two thousand five hundred and fifty) Winners are possible in the Promotion, who can receive a Guaranteed Gift, while 1 (one) Winner can receive only 1 (one) Guaranteed Gift to choose from those proposed in Clause 2 of these Rules.

WARNING! This Promotion is not a game of chance, lottery, gaming service, or contest, and these Rules are not a public promise of reward or contest terms.

3. Basic provisions of the Promotion
3.1. The promotion is held on the territory of the shopping and entertainment center "Lavyna", located at the address: Kyiv, Berkovetska street, 6D (hereinafter also referred to as "Lavyna" shopping center or shopping center), which will last from 2:00 p.m. August 15, 2024 at 5:00 p.m. 05.10.2024 inclusive (hereinafter referred to as the "Period of the Promotion").

The period of the Promotion may be changed by notification on the official website of the shopping center https://lavinamall.ua/ and the Customer's social media pages.

3.2. Who has the right to participate in the Promotion?

All citizens of Ukraine who permanently reside in Ukraine and who have reached the age of 18 at the start of the Promotion;
Participants of the Promotion may be natural persons, provided they fulfill the conditions of participation in the Promotion provided by these Rules.
3.3. The following are not recognized as participants of the Promotion and do not have the right to participate in the Promotion:

persons who have not reached the age of 18 at the time of the Promotion;
persons who have not fulfilled the conditions of these Rules;
non-residents of Ukraine;
owners and employees of the Customer/Organizer/Partner or representatives of the tenants of the "Lavyna" Shopping Center (including, but not limited to: store staff of the "Lavyna" Shopping Center), owners and employees of other third parties involved in the Promotion and maintenance of the "Lavyna" Shopping Center , including advertising agencies, cleaning, security and other organizations, as well as members of their families (husband (wife) and children who have reached the age of majority; as well as all persons living together, connected by common life, including persons , who live together but are not married).

4. Products, the purchase of which gives the right to participate in the Promotion
4.1. A mandatory condition for participating in the Promotion is the purchase of goods in the territory of the "Lavyna" shopping center (hereinafter referred to as "Goods"). The list and location of stores, the purchase of goods in which gives the right to participate in the Promotion, can be found on the shopping center website https://lavinamall.ua/ or directly in the shopping center at information counters/stands.

5. Conditions and procedure for participation in the Promotion
5.1. In order to acquire the status of a Participant of the Promotion, it is necessary during the period of the Promotion:

5.1.1. Make a purchase of Goods in the amount of UAH 1,500.00 or more. (one thousand five hundred hryvnias 00 kopecks) by one settlement document (cashier's check, commodity check, expense check, settlement receipt confirming the fact of sale (purchase) of goods, and registered in the prescribed manner by the registrar of settlement transactions or the software registrar of settlement transactions, or filled in manually) on which the place (address) of the purchase, date and amount of the purchase must be clearly indicated in any store on the territory of the shopping mall, excluding the "Silpo" supermarket;

5.1.2. Make a purchase of Goods in the amount of UAH 4,000.00 or more. (four thousand hryvnias 00 kopecks) by one settlement document, which must clearly indicate the place (address) of the purchase, the date and amount of the purchase in the "Silpo" supermarket;

5.1.3. Make a donation, the amount of which is a multiple of UAH 10;

5.1.4. Register settlement documents and donations in accordance with the terms of these Rules.

5.2. Registration of settlement documents confirming the purchase of goods, services, and donations is carried out by filling out the Questionnaire at the registration desk (promo desk) in the Avalanche Shopping Center near the stage.

5.3. The Participant of the Promotion fills out the Questionnaire independently or with the help of promoters at the promo counter on the territory of the "Lavyna" shopping center.

The working schedule of the promo counter and promoters:

Every day at the following hours:

• in the period from 15.08.2024 to 04.10.2024 inclusive:

Mon.-Fri.: from 2 p.m. until 8:00 p.m.;

Sat.-Sun.: from 12:00 p.m. until 8:00 p.m.;

• 05.10.2024: from 12:00 p.m. until 5:00 p.m.

5.4. Procedure for registration of Promotion Participants

5.4.1. The questionnaire is filled out by entering the following information about the Participant, namely:

Surname, first name, patronymic, amount of the settlement document, date of purchase, name of the store where the product was purchased, service, e-mail address, phone number.

5.4.2. After filling out the questionnaire, the Participant hands it over to the promoter, who must check if the Participant has an original settlement document for the amount specified in these Rules.

5.4.3. With the help of the QR code contained on the promotional stand, the Participant makes a donation in the amount specified in these Rules and presents confirmation of the donation made to the promoter.

5.4.4. After receiving the Questionnaire, checking the original settlement document and verifying that the Participant has made a donation, the promoter provides the Participant with a copy of the questionnaire with the attached original settlement document.

5.4.5. From the moment the Participant receives the root of the Questionnaire with the attached original settlement document, the Participant is considered registered to participate in the Promotion.

5.5. A participant who has fulfilled the conditions specified in clause 5.4 can receive a Guaranteed Gift and can participate in the drawing of Prizes from the Partner.

5.6. Terms of participation in the Promotion

5.6.1. The Participant has the right to participate in the Prize drawing only on the condition of personal presence at the drawing and to have with him the root of the application form with the attached original of the settlement document and a document certifying the identity and confirming the citizenship of Ukraine in accordance with the current legislation of Ukraine and to provide confirmation of the donation made during registration by the Participant.

5.6.2. Only payment documents (cheques) of the Participant of the Promotion with the date and time corresponding to the period of the Promotion and for which the registration in the Promotion has been made, in accordance with the terms of these Rules, are allowed to participate in the Promotion.

5.6.3. The Organizer's representatives can check that the participant has the documents specified in clause 5.6.1, including confirmation of the donation made by the participant.

5.6.4. The Participant receives the Prize and the Guaranteed Gift personally.

5.7. The following settlement documents do not meet the conditions of the Promotion:

- for goods and services that were not purchased during the Promotion Period (before 2:00 p.m. on August 15, 2024 and after 5:00 p.m. on October 5, 2024);

- settlement documents are drawn up in violation of the terms of these Rules.

5.8. One Participant has the opportunity to register an unlimited number of Questionnaires for each individual settlement document and one donation for participation in the Promotion during the entire period of the Promotion, provided that all conditions of these Rules are met.

5.9. By participating in the Promotion, the Participants of the Promotion thereby confirm the fact of familiarization with these Promotion Rules and their full and unconditional agreement with them.

5.10. Participants of the Promotion, participating in the Promotion, voluntarily agree to provide the Promotion Organizer with information (including personal data) determined by the Customer and the Promotion Organizer as necessary for receiving the relevant Promotion Prize.

5.11. Violation by the Participants of the Promotion of these Rules or the refusal of the Participants of the Promotion to properly comply with these Rules (including the conditions specified in these Rules, the procedure and deadlines for the Promotion and/or receiving the Prizes of the Promotion, etc.) shall be considered a refusal by the Participant to participate in the Promotion and receive the Prize and Guaranteed gift. At the same time, such a person does not have the right to receive any compensation from the Customer and the Promotion Organizer.

5.12. The participants of the Promotion must keep the original invoice documents for the Goods, to confirm the purchase of goods in the "Lavyna" Shopping Center during the period of the Promotion.

5.13. The Customer and/or the Organizer of the Promotion has the right to demand from the Participant of the Promotion to present the originals of settlement and other documents and other information stipulated by these Rules, at any time at their discretion.

5.14. The Customer and/or the Organizer of the Promotion have the right, and the Winner is obliged to submit for verification the originals of settlement and other documents and other information provided by these Rules within 14 days from the moment of determining the winner.

6. Conducting the drawing of Prizes within the Promotion
6.1. The draw will be held on October 5, 2024 from 5:00 p.m. until 6:00 p.m. The customer has the right to change the dates and time of the draw.

6.2. The Customer can inform about the exact time or change of the date and time of the raffle within the Promotion on the official website of the shopping mall https://lavinamall.ua/ and/or on the Customer's social media pages.

WARNING! Prize draw ends at 6:00 p.m. October 5, 2024 or (if it is changed) on the day and time specified on the official website of the shopping center https://lavinamall.ua/ and/or on the Customer's social media pages as the end time of the draw.

6.3. The Winner of the Promotion will be determined by the Organizer based on random probability by drawing lots among all registered Participants participating in the Promotion. The draw will take place as follows:

6.3.1. The organizer (the host of the drawing) will select the appropriate number of Winners of the Promotion using the lottery machine, which will contain the registered Questionnaires of the registered Participants of the Promotion, by means of a "blind" draw (choosing the Questionnaires without previewing their content).

6.3.2. The Participant of the Promotion, whose Questionnaire will be determined to have won the Prize, will be notified of this immediately at the location of the draw on the day of the draw by means of a verbal announcement.

6.3.3. The presence of the Promotion Participant at the location of the Prize draw is a mandatory condition for receiving the Prize.

6.3.4. If the Promotion Participant, whose Questionnaire will be determined to have won the Prize, within 5 (five) minutes from the moment of the relevant announcement, does not confirm his presence at the location of the draw (lottotron), the Organizer (host of the draw) must call him once at the number phone number specified in the Questionnaire.

6.3.5. If the Promotion Participant does not pick up the phone or, having picked up the phone, does not confirm his participation in the Promotion and presence in the "Lavyna" Shopping Center and/or does not fulfill the requirements of these Terms and Conditions, he loses the right to receive the Prize, and the Prize is re-drawn among other Participants based on a random probability , by drawing lots among all other Questionnaires.

6.3.6. In the event that a Questionnaire belonging to an already selected Participant is selected from the Lottotron, such Questionnaire is not taken into account and is removed from the Lottotron, and the drawing is carried out again in accordance with these Rules.

6.3.7. If the Participant, whose Questionnaire was drawn from the Lottotron, did not appear at the place indicated by the Organizer, another Winner will be chosen by lot.

6.3.8. If the Participant has fulfilled all the conditions stipulated by these Rules, he is declared the Winner and receives the right to the Prize.

6.3.9. The winner receives the Prize only on the condition that all documents and information specified in these Rules are verified.

6.3.10. The Winner who did not pass or refused to pass the inspection specified in Clause 6.3.9 loses the status of the Winner and does not receive the Prize.

WARNING! The Organizer and/or the Customer of the Promotion reserves the right to change the algorithm and the time of the draw and the determination of the Winner.

In the case of the announcement of an air alert in the city of Kyiv and/or the Kyiv region, the raffle is suspended until the air alert is lifted and resumes after the air alert is announced. In the event of a long-term air disturbance, the raffle may be postponed to another day, which will be announced on the official website of the shopping center https://lavinamall.ua/ and/or on the Customer's social media pages.

In the event of an air alarm lasting more than 3 hours in a row, the Customer and/or the Organizer of the Promotion reserve the right to hold a prize draw online on the Instagram page. https://www.instagram.com/lavinamall.ua?igsh=M2Fwa2N6MXhzaHFz

In this case, changes to the conditions of the draw will be notified additionally on the official website of the shopping center https://lavinamall.ua/ and/or on the pages of social networks of the Customer.

6.4. Winners will be notified of their victory in the Promotion immediately during the draw.
6.5. Prizes are awarded after the draw.

6.6. Receiving the Prize by the Winner is carried out by the Organizer presenting the Prize on the central stage of the shopping center on the day of the event.

6.7. From the moment the Winner receives the Prize, the obligations of the Customer and the Organizer to transfer the Prize are considered fulfilled in full.

6.8. The Organizer, the Customer and the Partner are not responsible for the impossibility of awarding the Prize to the Winner due to the latter's refusal to pass the inspection specified in these Official Terms.

6.9. The Prize to the Winner of the Promotion is awarded by the Organizer of the Promotion.

6.10. The Promotion Partner is recognized as a tax agent upon awarding the Prize, and undertakes to pay all relevant taxes and fees related to awarding the Prize.

6.11. The Customer/Organizer for awarding the Prize has the right to ask the Winner:

• Original/copy of documents certifying identity and confirming citizenship of Ukraine and a certificate of assignment of the registration number of the taxpayer's registration card;
• the original settlement document that was registered in the Promotion, exclusively for familiarization and verification of the Participant's compliance with all the terms of the Promotion.

6.12. The winner of the Promotion has the opportunity to receive the Prize after the Customer and/or the Organizer has checked the original payment document specified by the Winner when registering for the Promotion, as well as on the condition of providing a copy of the identity document and confirming the citizenship of Ukraine and a certificate of assignment of the registration number of the taxpayer’s registration card (for the conditions of the absence of the Winner's application to return the high-quality Goods according to the settlement document (cheque), which became the basis for determining the Winner, in accordance with the requirements of Article 9 of the Law "On the Protection of Consumer Rights") and signing the statement-confirmation of receipt of the Prize and consent to the processing of personal data . In the event that the Winner submits an application for the return of the Goods according to the settlement document, which became the basis for determining the Winner, within the terms specified by the legislation of Ukraine, the Winner loses the right to receive the Prize.

6.13. The Customer and the Organizer have the right to:

deny participation in the Promotion to a person who has not/improperly fulfilled all the conditions for participation in the Promotion specified in these Rules;
refuse to issue the Prize/Prizes to the Winner who has not fulfilled the conditions necessary for receiving such Prize/Prizes, according to these Rules.
6.14. The Customer and the Organizer bear no responsibility for the accuracy of the information provided by the Participants of the Promotion, including contact information with them.

6.15. When receiving the relevant Prize, the Winner signs with the Customer/Organizer of the Promotion a statement confirming receipt of the Prize and consent to the processing of personal data, the forms of which are determined by the Customer/Organizer of the Promotion.

6.16. The Winner’s refusal to receive the Prize and/or refusal to sign the proposed documents provided for in these Rules, including the submission of these documents after the specified deadline, or the provision of information that has signs of being fictitious or unreliable, deprives the Winner of the right to receive the Prize and is considered the Winner’s refusal to receiving the Prize.

6.12. If the Winner is unable/willing to use/receive the Prize for reasons beyond the control of the Customer/Organizer of the Promotion, the Customer/Organizer shall not pay the Winner any compensation related to such inability to use/receive the Prize.

6.13. Replacement of the Prize with other goods/services is not allowed.

7. OTHER TERMS
7.1. The Customer/Promotion Organizer reserves the right to change these Rules, the date and time of any raffle(s) and determination of the Winner, etc. Information about the changes can be found on the official website: https://lavinamall.ua/

7.2. The Customer/Organizer of the Promotion is not responsible for the inability of the Winner to receive the Prize for any reason beyond the control of the Customer/Organizer of the Promotion, including due to the fact that the Winner indicated (provided) incorrect (false) and/or incomplete data, etc., which are necessary for accepting participation in the Promotion, including the Winner's reference to illness, vacation, interruptions in the work of communication operators of Ukraine, etc. At the same time, such a Winner is deprived of the right to receive any compensation from the Customer/Organizer.

7.3. The Customer/Organizer of the Promotion is not responsible for the future use of the Prizes.

7.4. The Winner agrees that in case he receives the Prize, his personal data, which were provided to the Customer/Organizer of the Promotion, as well as the recording of the process of awarding the Prize itself, may be used in printed, audio and video materials without additional special consent of the Winner, and such use by no in this way the Winner is not paid.

7.5.The Customer/Organizer of the Promotion shall not bear any responsibility for failure to conduct the Promotion or award the Prize in the event of force majeure (including natural disasters, fires, floods, military operations of any nature, blockades, terrorist attacks, notices of landmines , significant changes in the current legislation, which is in effect in the territory of the event during the Promotion period, etc.) or other circumstances that make it impossible or difficult to fulfill the duties, and do not depend on the will of the Customer/Organizer of the Promotion.

7.6. In the event of a situation that implies an ambiguous interpretation of these Rules, any disputed issues and/or issues not regulated by these Rules, the final decision is made by the Customer/Promotion Organizer. The decision of the Customer/Promotion Organizer is final and not subject to appeal.

7.7. The fact of filling out the Participant's Questionnaire means the Participant's full consent to all the provisions of the Official Terms of the Promotion, as well as consent to the use, storage and processing of their personal data in accordance with the Law of Ukraine "On the Protection of Personal Data", to their transfer to third parties, with marketing and/or for any other purpose, by methods that do not contradict the current legislation of Ukraine (including by transfer to third parties), in particular, for the free use of his name, surname, image (photo or video), interview or other materials about him for advertising purposes, including the right to publish his name and image (photo or video) in mass media, any printed, audio and video materials, interviews with mass media, without limitation on the territory and term of such use, and such use is not compensated (paid) by the Organizer, Partner, Customer or third parties. Also, it is considered that the Participant has given his consent to the use of his name and image within the meaning of Art. 296, 307, 308 of the Civil Code of Ukraine.

The participants of the Promotion are familiarized with their rights provided for in Art. 8 of the Law of Ukraine "On Personal Data Protection".

7.8. In cases where the Partner, while fulfilling the obligations assumed within the scope of this Promotion, carries out any operations that are subject to taxation in accordance with the legislation of Ukraine, the Partner ensures the payment of all taxes, fees and mandatory payments provided for by the current legislation of Ukraine, including personal income tax; preparation and submission of relevant tax reporting. Taking into account the terms of this paragraph, the Winner agrees that the Partner's payment of relevant taxes, fees and mandatory payments, including personal income tax, does not exempt the Winner from submitting an annual declaration of assets and income for the previous year in accordance with Art. 67 of the Constitution of Ukraine and Art. 179 of the Tax Code of Ukraine.

7.9. The rules are approved by the Customer/Organizer of the Promotion and are valid for the duration of the Promotion.
