Program of the "MILLION FOR SHOPPING AT LAVINA" Promotion at JSC "CLEARING HOUSE"
1. General Provisions
1.1. The organizer of the Promotion is JSC "CLEARING HOUSE" (hereinafter referred to as the Bank/Organizer). The Organizer ensures the conduct of the Promotion, the determination of winners and the payment of prizes.
1.2. The program of the Promotion "A Million for Shopping at LAVINA" (hereinafter referred to as the Promotion or the Program) regulates the procedure, terms and conditions of the Promotion and the conditions of participation in the Promotion.
1.3. The purpose of the Promotion:
- attracting new clients - individuals to serve;
- popularizing non-cash payments with the Organizer's bank cards;
- increasing the issuance of payment cards, turnover on them and, accordingly, income from card transactions.
1.4. The Program is developed in accordance with the current legislation of Ukraine, the requirements of regulatory legal acts of the National Bank of Ukraine, the Tax Code of Ukraine, the Law of Ukraine "On Advertising" and internal regulatory documents of the Bank.
1.5. The Promotion is not a lottery, gambling or service in the gambling business
2. Promotion Terms
2.1. Territory and terms of the Promotion:
The Promotion is held on the territory of Ukraine from 01.04.2026 to 16:00 31.05.2026
2.2. Promotion Participants:
Participation in the Promotion is voluntary. The fact of participation means the Participant's full and unconditional consent to this Program.
By participating in the Promotion, the Participant consents to the processing of his/her personal
data.
Personal data is processed in accordance with the Law of Ukraine "On
Protection of Personal Data".
The data is used exclusively for the Promotion and compliance with the requirements of the law.
2.2.1. The Promotion is open to individuals who meet all of the following requirements:
- are holders of a payment card of the Bank included in the “Lavina+” service package
- have reached the age of majority (18 years) and are residents of Ukraine;
- have fulfilled the terms of this Program.
2.2.2. The following cannot participate in the Promotion:
- employees of the Organizer;
- employees of the Promotion partners;
- members of their families.
2.3. Promotion Terms:
2.3.1. The condition for participation is to make transactions with the Organizer’s card included in the “Lavina”+ service package at retail outlets located in shopping malls participating in the Promotion at the time of the transaction.
2.3.2. The list of retail outlets participating in the Promotion is determined by the Organizer and announced on the Organizer’s official resources.
2.3.3. To participate in the Promotion, the Participant must:
- pay for goods or services with the Organizer's card, which is included in the "Lavina"+ service package;
- the transaction amount must be at least 100 UAH;
- the transaction must be made at retail outlets located in the shopping center and belong to those participating in the program at the time of the transaction;
- Each transaction for an amount of 100 UAH or more is a separate participation in the Promotion. In this case:
a) Only those transactions that are made with bank cards issued by the Organizer and included in the "Lavina+" service package, carried out through payment terminals of retail outlets located in the shopping center and participating in the Promotion at the time of the transaction, and successfully authorized and confirmed by the payment system are eligible for participation in the Promotion.
b) The following are not taken into account for participation in the Promotion: canceled transactions, refunds, transactions that were contested by the client, technical or test transactions, as well as transactions from accounts on which the Organizer imposed temporary or permanent restrictions at the time of such transactions and/or the time of verification of transactions before determining the winners.
2.4. Promotion Prize Fund
2.4.1. The Promotion Prize Fund consists of 5 (five) cash prizes of UAH 200,000 each.
2.4.2. The total Promotion Prize Fund is UAH 1,000,000.
2.4.3. The Prize Fund is formed at the expense of the Organizer.
2.4.4. Prizes cannot be exchanged for other goods or services.
3. Procedure for conducting the Promotion and determining the winners
3.1. In order to provide advance information about the Promotion:
3.1.1. The Organizer places relevant information on the Bank’s website https://www.clhs.com.ua and in customer service areas. It informs current and potential customers through other channels, including through the Bank’s mobile application.
3.1.2. The shopping mall places relevant information in the information and advertising areas of the shopping mall
3.2. The venue for the draw is the Lavina Mall shopping and entertainment center, located at 6D Berkovetska Street, Kyiv, Kyiv (hereinafter referred to as the shopping mall)
3.3. The Organizer has the right to involve third parties (partners) to organize and provide technical support for the Promotion.
3.4. The date and time of the draw are determined by the Organizer and notified to the Participants additionally.
3.5. To be eligible to win a prize, the Participant must be personally present during the draw at the shopping mall.
3.6. In the event of the Participant's absence when the winner is announced, the Organizer has the right to re-determine the winner.
3.7. The procedure for determining the winners:
3.7.1. The Organizer has the right to check all transactions before determining the winners
3.7.2. The winners are determined during a public draw on the territory of the shopping mall
3.7.3. The winners are determined randomly among all transactions that meet the terms of the Promotion.
3.7.4. During the draw, the winner is announced in real time.
3.7.5. The Participant must confirm his presence at the place of the draw.
3.7.6. In the event of the winner's absence, the Organizer has the right to determine another winner.
3.8. Draw Procedure
3.8.1. Before the draw, the Organizer forms a register of transactions that meet the terms of the Promotion.
3.8.2. The register is formed on the basis of internal bank data.
3.8.3. Winners are determined randomly using software or another random selection mechanism.
3.8.4. After determining the winner, his name, the last 4 digits of the card number and phone number are announced by the host of the event.
3.8.5. The winner must personally confirm his presence at the draw location.
3.8.6. If the winner does not appear within the time specified by the Organizer, the winner will be determined again.
3.9. Confirmation of victory
3.9.1. The winner must personally confirm his presence at the draw location.
3.9.2. To confirm the win, the winner must answer the call from the Organizer's representatives within 180 seconds after being announced as the winner.
3.9.3. If the winner does not confirm his presence at the specified time, such participant is considered to have refused to receive the prize.
3.9.4. In such a case, the Organizer has the right to re-determine the winner.
3.10. Reserve winners
3.10.1. Reserve winners may be determined during the draw.
3.10.2. The reserve winner is entitled to the prize if the main winner did not confirm his presence, the winner refused the prize, the winner did not provide the necessary documents to receive the prize.
3.10.3. The number of reserve winners is determined by the Organizer.
3.11. Announcement of the results of the Promotion
3.11.1. Information about the winners of the Promotion may be published on the official website of the Organizer, on the Organizer's social networks, on the information resources of the Promotion partners.
3.11.2. The publication of the results may contain the winner's name, city of residence, photo or video of the prize presentation.
3.11.3. By participating in the Promotion, the Participant agrees to the possibility of publishing such information.
3.12. Publicity of the draw
3.12.1. The winners are determined publicly on the territory of the shopping mall.
3.12.2. The draw may be accompanied by photo and video shooting, online broadcast, and the presence of visitors to the shopping center.
3.12.3. By participating in the Promotion, the Participant agrees to the use of his/her name, publication of photos or videos from the draw, and the use of these materials for the advertising purposes of the Organizer and the shopping mall.
3.13. Procedure for receiving the prize:
3.13.1. To receive the prize, the winner must provide a passport of a citizen of Ukraine, the registration number of the taxpayer's account card and consent to receive the prize.
3.13.2. The prize is paid by transferring funds to the winner's bank account using the payment card of which the transaction was made, which determined him as the winner.
3.13.3. The prize is paid within the period specified by the Organizer after confirming the winner's status, but not earlier than the first business day following the day of the draw.
3.14. Taxation of the reward:
3.14.1. The cost of the prizes is included in the taxable income of an individual.
3.14.2. When paying the prize, the Organizer acts as a tax agent.
3.14.3. Taxes are withheld from the prize amount in accordance with the Tax Code of Ukraine: 18% — personal income tax, 5% — military duty.
3.14.4. The winner receives the prize amount minus taxes and fees.
4. Other terms of the Promotion
4.1. The Organizer reserves the right to extend the Promotion period and/or change the Promotion Program at its own discretion, while announcing such changes in the same manner as announcing the Promotion.
4.2. Participation in the Promotion automatically means the fact of familiarization and full unconditional consent of the Promotion Participant to this Program. Violation of this Program by the Promotion Participant or refusal of the Promotion Participant to properly implement this Program is considered the Participant's refusal to participate in the Promotion, and such a person is not entitled to receive any compensation from the Promotion Organizer.
4.3. The Organizer is not responsible for technical failures in the operation of payment systems, inability to participate in the Promotion for reasons beyond the Organizer's control.
4.4. The Organizer has the right to refuse to award a prize in the event of a Participant's violation of these Rules.
4.5. The Organizer reserves the right to disqualify the Participant in the event of detection of signs of fraud or manipulation. Such actions may include:
4.5.1. artificial creation of transactions without actual purchase of goods, multiple transactions with subsequent refunds, use of technical or software tools to obtain an advantage in the Promotion.
4.5.2. In the event of detection of such actions, the Organizer has the right to cancel the Participant's participation without explaining the reasons.
5. Final provisions
5.1. The Program shall enter into force upon its approval by the Board of the Bank (Organizer).
5.2. Changes and additions to this Program shall be made by their approval by the Board of the Bank and shall be formalized in the appropriate protocol.
5.3. The Organizer of the Promotion is not responsible in the event of force majeure circumstances such as natural disasters, fires, floods, military actions of any nature, blockades, or in cases of significant changes in the current legislation in force in the territory of the Promotion, other circumstances beyond the control of the Organizer of the Promotion.
5.4. In the event of a situation that allows for an ambiguous interpretation of this Program and/or issues not regulated by this Program, the final decision is made by the Organizer of the Promotion in accordance with the requirements of the current legislation of Ukraine. In this case, the decision of the Organizer of the Promotion is final and cannot be appealed.
